The document sent to the Minister of Justice and Chairmen of People's Committees of provinces and centrally-run cities stated: On July 9, 2023, the Prime Minister issued Directive No. 23/CT-TTg on promoting reform of administrative procedures for issuing Judicial Records to facilitate people and businesses.
In the Directive, the Prime Minister requested Ministers, Heads of ministerial-level agencies, Government agencies, and Chairmen of People's Committees of provinces and centrally-run cities to thoroughly grasp and comply with the right to request the provision of Criminal Records in accordance with the provisions of Clause 3, Article 7 of the Law on Criminal Records; and take measures to rectify the abuse of requests for submission of Criminal Records by organizations and enterprises.

However, recently, the Government Office - the standing agency of the Prime Minister's Administrative Procedure Reform Working Group has received press information and feedback from the people about: Some regulations on procedures for issuing Criminal Records have caused many difficulties, problems and costs for people when carrying out procedures; some companies when recruiting delivery people require the provision of Criminal Records.
Specifically, the press reported: Some regulations on procedures for issuing Criminal Record Certificate No. 2, such as: Not allowing authorization to submit documents and receive results of Criminal Record Certificate No. 2; or the regulation that there are 02 types of Criminal Record Certificates has caused many difficulties, problems and costs for people when carrying out procedures.
Along with that, the reflection of citizen Han Van Vinh, residing in Thanh Son town, Thanh Son district, Phu Tho province about: He needs to apply for a job at some delivery units. However, all companies require to provide a Criminal Record. Without a Criminal Record, the job application will not be accepted.
In carrying out the tasks assigned by the Prime Minister, the Prime Minister's Working Group on Administrative Procedure Reform requests the Minister of Justice to direct the study and handling of the above-mentioned press content regarding regulations on procedures for issuing Judicial Records.
Chairmen of People's Committees of provinces and centrally run cities direct inspections and request organizations and enterprises in the area to seriously implement Directive No. 23/CT-TTg dated July 9, 2023 of the Prime Minister to limit the abuse of requests for providing Criminal Records.
Report to the Working Group Leader the handling results and remedial solutions before October 20, 2023.
