
Continuing the meeting this morning, November 4, the National Assembly discussed in groups the following drafts: Law on temporary detention, temporary imprisonment and prohibition from leaving the place of residence; Law on enforcement of criminal judgments (amended); Law on amendments and supplements to a number of articles of the Law on Judicial Records. National Assembly Chairman Tran Thanh Man participated in the discussion in Group 11, including the National Assembly Delegation of Can Tho City and the National Assembly Delegation of Dien Bien Province.
Speaking at the group discussion session, National Assembly Chairman Tran Thanh Man stated that the three projects: Temporary detention, temporary imprisonment and prohibition from leaving the place of residence; Law on Criminal Judgment Enforcement (amended); Law on amending and supplementing a number of articles of the Law on Judicial Records are of extremely important significance, serving judicial reform, cutting down administrative procedures, and creating convenience for the people.
The National Assembly Chairman requested that drafting agencies continue to listen to opinions of experts and scientists to perfect the above draft laws.

In the current context, the National Assembly Chairman noted that it is necessary to apply digitalization, digital transformation, and artificial intelligence in the above fields, exploit and make maximum use of relevant national databases, especially national databases on population, the Electronic Identification and Authentication System (VNeID) built by the Ministry of Public Security, and at the same time refer to effective models of other countries so that the amendment and supplementation of the Laws can reduce administrative levels, improve management efficiency, and truly meet the requirements of state management, management of security, order, and social safety.
In addition, the National Assembly Chairman also noted the issue of data security risks, especially sensitive data such as criminal records.
At Group 11, National Assembly delegates noted that the new points in the draft Law amending and supplementing a number of articles of the Law on Judicial Records have basically followed reality; met the requirements of promoting the application of science and technology in building databases, cutting administrative procedures and also very well received the opinions of delegates in the recent past.

National Assembly Chairman Tran Thanh Man said that people are looking forward to reforming the procedures for issuing criminal records. This time, the amendment to the Law must ensure the simplification of documents, reduce time, promote online implementation; free for children, the elderly, the disabled, poor households, promote level 4 public services... This issue will create convenience for people because currently most job applications and paperwork require a criminal record.
Regarding the construction and management of the criminal records database, according to the National Assembly Chairman, it is possible to add regulations on data standards to avoid data abuse.
To continue perfecting the draft Law, National Assembly Deputy Nguyen Van Quan (Can Tho) proposed expanding the authority to issue criminal records to commune-level police to facilitate people's implementation and also in line with the spirit of Directive No. 23 of the Prime Minister on promoting administrative procedure reform, creating favorable conditions for people and businesses.

"Especially in the current two-level local government organization, if people have to go to the provincial or city police center to get their criminal records, many localities are very far away. Currently, we have also connected the databases. Perhaps we can consider upgrading the facilities of communes and wards to gradually implement this procedure for people at the commune level," delegate Nguyen Van Quan emphasized.
 Currently, according to the delegate, we have established and the draft Law has also specifically stated the connection of the population database with the civil status database. Therefore, delegate Nguyen Van Quan also requested the drafting agency to consider and design a provision on the interconnection mechanism for relevant agencies to exploit data on criminal records through specialized databases of relevant agencies in the implementation of administrative procedures without forcing people to submit criminal records.
"It may not be expanded, but for some necessary agencies, it can be connected so that people are not required to submit a criminal record, but state management agencies can connect with each other and extract it themselves to serve their management. This is also an effective solution to strengthen administrative reform and create convenience for people," emphasized delegate Nguyen Van Quan.

Expressing his agreement with the above proposal, National Assembly Deputy Hoang Thanh Tung (Can Tho), Chairman of the Committee on Law and Justice, said that the proposal to expand the authority to issue criminal records to commune-level police should be studied because it is also very suitable for the policy of promoting decentralization, suitable for current conditions, and at the same time, creating favorable conditions for the people.
The Chairman of the Law and Justice Committee said he will coordinate with the drafting agency to research, absorb, and report to the National Assembly Standing Committee and the National Assembly on the above content.
