Administrative sanctions for violations in the field of planning and investment for enterprises

Location of the Commercial Housing Project at the intersection of Trieu Quang Phuc Street and Hoang Dieu Street, Lao Cai Ward, Lao Cai City (TDHOME Lao Cai).

The decision clearly states that the joint venture of Hung Yen Import-Export Joint Stock Company and Thai Duong Construction and Development Joint Stock Company committed the following administrative violations:

Failure to implement the 6-month periodic investment monitoring and evaluation reporting regime in 2022 as prescribed in Point a, Clause 8 and Point a, Clause 11, Article 100 of Decree No. 29/2021/ND-CP dated March 26, 2021 of the Government regulating the order and procedures for appraising important national projects and monitoring and evaluating investment for the Commercial Housing Project at the intersection of Trieu Quang Phuc Street and Hoang Dieu Street, Lao Cai Ward, Lao Cai City (TDHOME Lao Cai).

Failure to implement the 6-month periodic investment monitoring and evaluation reporting regime in 2023 as prescribed in Point a, Clause 8 and Point a, Clause 11, Article 100 of Decree No. 29/2021/ND-CP dated March 26, 2021 of the Government regulating the order and procedures for appraising important national projects and monitoring and evaluating investment for the Commercial Housing Project at the intersection of Trieu Quang Phuc Street and Hoang Dieu Street, Lao Cai Ward, Lao Cai City (TDHOME Lao Cai).

Preparing the periodic investment monitoring and evaluation report for 2023 (before February 10, 2024) not on time as prescribed in Point a, Clause 11, Article 100 of Decree No. 29/2021/ND-CP dated March 26, 2021 of the Government regulating the order and procedures for appraising important national projects and monitoring and evaluating investment for the Commercial Housing Project at the intersection of Trieu Quang Phuc Street and Hoang Dieu Street, Lao Cai Ward, Lao Cai City (TDHOME Lao Cai).

Failure to comply with the contents of the Decision approving the investment policy and approving the investor No. 28/QD-BQL dated January 28, 2022 of the Lao Cai Provincial Economic Zone Management Board granted to the investor, the Joint Venture of Hung Yen Import-Export Joint Stock Company and Thai Duong Construction and Development Joint Stock Company, to implement the Commercial Housing Project at the intersection of Trieu Quang Phuc Street and Hoang Dieu Street, Lao Cai Ward, Lao Cai City (TDHOME Lao Cai). Specifically, the investor has not completed the procedures according to Clause 8, Article 1 of Decision No. 28/QD-BQL (environmental procedures, fire prevention and fighting, etc.); has not constructed the construction items according to the provisions of Clause 8, Article 1 of Decision No. 28/QD-BQL; has not completed the project and put it into use according to the provisions of Clause 8, Article 1 of Decision No. 28/QD-BQL.

In addition to the fine, investors are required to periodically report on investment monitoring and evaluation for the first 6 months of 2022 and the first 6 months of 2023 as prescribed.
