Ensuring the safety of aviation operations

Air transport businesses in Vietnam must meet a number of strict conditions to ensure the safety of industry operations.

Strict business conditions

On September 18, the Ministry of Construction issued Document 15/VBHN-BXD consolidating the Decree regulating conditional business lines and occupations in the field of civil aviation.

The recently issued consolidated document is based on Decree No. 92/2016/ND-CP (dated July 1, 2016) and amended and supplemented documents including Decree No. 89/2019/ND-CP, Decree No. 64/2022/ND-CP, Decree No. 15/2024/ND-CP and most recently Decree No. 89/2025/ND-CP (effective from April 13, 2025). There are currently 6 groups of conditional business lines in civil aviation, including: air transport business; airport and airport business; aviation service business at airports and airports; aircraft and aircraft equipment design, production, maintenance and testing services; flight operation assurance services; aviation staff training and coaching services.

In particular, Chapter 2 of the Decree focuses on air transport business, including air transport business (transporting passengers, goods, and postal items for profit) and general aviation business (general aviation activities for profit by aircraft, except unmanned aircraft).

Conditions for air transport business require enterprises to meet requirements on ensuring aircraft for operation, organizational structure, capital, and business plan.

Regarding minimum capital (including equity and loan capital): Operating up to 10 aircraft - 300 billion VND; Operating from 11 to 30 aircraft - 600 billion VND; Operating over 30 aircraft - 700 billion VND; General aviation business - 100 billion VND.

Regarding aircraft, the minimum number of aircraft maintained during the entire air transport business is 3 aircraft for air transport business and at least 1 aircraft for general aviation business.

Regarding foreign investment capital, for air transport businesses with foreign investment capital, foreign investors are only allowed to hold no more than 34% of charter capital.

Conditions on ports and aviation services

For airport business, enterprises must be granted a License when meeting the conditions of minimum capital of 100 billion VND and the capital ratio of foreign investors does not exceed 30% of charter capital.

For aviation service business at airports (including passenger terminal operation, cargo terminal operation, aviation fuel supply, etc.), the minimum capital for these main services is 30 billion VND. Similarly, the capital contribution ratio of foreign individuals and organizations for many important services (such as terminal operation, fuel services, ground commercial technical services) must not exceed 30% of charter capital.

Along with that, the process of granting an Air Transport/General Aviation Business License is a strict process, starting from submitting the application to the Civil Aviation Authority of Vietnam, through the appraisal of the Civil Aviation Authority of Vietnam (20 days), submitting it to the Ministry of Transport (15 days), and finally the Prime Minister reviews and allows the issuance of the License (10 days).

The license can be revoked in many cases, including: Failure to maintain minimum capital for 3 consecutive years, intentional falsification of information in the dossier, suspension of air transport operations for 36 consecutive months, or serious violation of aviation security and safety regulations.

Enterprises operating in conditional business lines in the field of civil aviation must operate in accordance with the purposes and contents stated in the license and maintain sufficient conditions for being granted licenses and certificates according to this Decree. In particular, enterprises must meet the minimum capital requirements and must annually submit fully accepted audited financial reports to the Civil Aviation Authority of Vietnam for inspection and supervision of capital maintenance.
