A notary in Ho Chi Minh City was arrested for signing wrongly, causing a loss of 15.7 billion VND.

(Dan Tri) - Mr. Nguyen Duy Thuc violated the provisions of the Notary Law by not requiring the notary to sign or fingerprint in front of the notary, and not checking the documents, causing a loss of 15.7 billion VND.


On December 10, the Ho Chi Minh City Police Department prosecuted and temporarily detained notary Nguyen Duy Thuc (born in 1972, residing in Thu Duc City) for the crime of Lack of responsibility causing serious consequences; prosecuted Trinh Truong Giang (born in 1971, residing in Tan Phu District) and Tran Thanh Hai (born in 1983, residing in District 12) for the crime of Fraudulent appropriation of property.

Previously, the Ho Chi Minh City Police Investigation Agency (PC01 Department) received a petition from Mr. HND accusing a notary of wrongdoing in performing his duties, causing Mr. D. a loss of 15.7 billion VND.

During the verification, Department PC01 determined that land plot number 706, map sheet number 02 (currently plot number 01 and 02, map sheet 96) in Ward 5, Go Vap District is owned by Ms. D.TT.

On January 9, Ms. T. signed a deposit contract to sell the above land plot to 3 people who contributed capital to buy it. Because this land plot is in dispute over the common access with surrounding households, after signing the deposit contract, all 3 agreed to assign Trinh Truong Giang to perform the service contract including: Agreement to resolve the access dispute with surrounding households; contact the competent authority to submit documents and procedures to transfer the land plot to the names of the 3 buyers.

Upon receiving the original land documents from Ms. T., Giang did not perform the service as agreed but gave the land documents to Tran Thanh Hai for safekeeping. Later, Giang knew Mr. HND before, so he went to meet and invite the victim to buy the above land plot.

On October 3, 2018, Ms. TTTT (Mr. D's wife) signed a handwritten contract to buy and sell the above land plot with Tran Thanh Hai, and Trinh Truong Giang was the witness to the contract.

Although Ms. D.TT did not sign the authorization contract with Mr. HND, Nguyen Duy Thuc violated the provisions of the Notary Law. Specifically, Thuc did not ask the notary to sign or fingerprint in front of the notary, did not check the documents but still performed the notarization, resulting in Trinh Truong Giang and Tran Thanh Hai appropriating 15.7 billion VND from Mr. HND.
