The Ministry of Public Security said that Decree No. 144/2021 on the use of unmanned aerial vehicles such as Flycam, Drone, UAV... specifies the penalty for not being licensed.

In what cases is a flight permit exempted?

Accordingly, the act of using unmanned aircraft or ultralight aircraft that have not been registered for a flight license or organizing flight activities without a license or having registered but not controlling the flight at the correct time, location, area, coordinates, or permitted limits will be subject to a fine of 1 - 2 million VND.

For the act of operating drones and ultralight aircraft not in accordance with the content of the flight license issued by the competent authority, the fine is from 8 to 10 million VND.

The highest level is a fine of 20 - 30 million VND for the act of operating drones and ultralight aircraft without a flight permit issued by a competent authority.

Fine up to 30 million for flying Flycam without license

In addition, there are additional penalties of confiscation of exhibits and means of administrative violation and revocation of flight license from 3 to 6 months for violations.

Regarding cases exempted from flight licenses, the Ministry of Public Security said that, based on Clause 3, Article 30 of the Law on People's Air Defense, effective from July 1, 2025, unmanned aircraft and other flying vehicles in one of the following cases are exempted from flight licenses:

Firstly, operating outside of no-fly zones, restricted flight zones, operating within visual range, with a maximum take-off weight of less than 0.25 kg for entertainment purposes;

Second, operate in emergency situations to protect the lives and property of organizations and individuals according to the decision of competent authorities but must notify the aviation management agency before flying.

Regarding the procedures and documents for applying for a license to use unmanned aerial vehicles in Vietnam, the regulations are as follows:

Individuals and organizations that need a license to use drones and ultralight aircraft must submit their application within 7 working days.

Licensed within 5 days

Before the scheduled date of flight organization, organizations and individuals submit flight permit applications to the Department of Operations - General Staff - Ministry of National Defense (submit directly at the one-stop department of the Ministry of National Defense or via public postal service to the Department of Operations, No. 1 Nguyen Tri Phuong, Ba Dinh, Hanoi or submit online on the public service portal of the Ministry of National Defense ).

Within 5 working days, the Operations Department shall grant permission to organize flights or issue a document refusing to grant a flight permit (in cases to ensure security, national defense, aviation safety and when not providing full information as prescribed in the flight permit application).

To facilitate Vietnamese and foreign organizations and individuals involved in the management, exploitation, and use of drones and other flying vehicles in Vietnam's airspace, on June 15, 2025, the Ministry of National Defense officially announced no-fly zones and restricted flight zones for drones and other flying vehicles.

Photos of aircraft and flying vehicles (minimum size 18 x 24cm);

Technical description of aircraft and flying vehicles;

License or legal authorization allowing aircraft and flying vehicles to take off and land at airports, areas on land or water;

Other papers and documents related to aircraft and flying vehicles.
