Ministry of Industry and Trade issues many policies to support small and medium enterprises

Pursuant to Decision No. 55/2019/ND-CP, the Ministry of Industry and Trade has issued plans to support and provide legal advice to small and medium-sized enterprises within its management scope.

The Ministry of Industry and Trade has just issued Official Dispatch No. 3760/BCT-PC, reporting on the results of implementing the responsibilities of ministries and ministerial-level agencies in implementing legal support work for small and medium-sized enterprises according to Official Dispatch No. 2704/BTP-PB&TG of the Ministry of Justice .

According to the report of the Ministry of Industry and Trade , after the National Assembly passed the Law on Support for Small and Medium Enterprises on June 12, 2017 and it took effect on January 1, 2018, the Government issued Decree No. 55/2019/ND-CP dated June 24, 2019 of the Government on legal support for small and medium enterprises.

The Decree details legal support activities for small and medium-sized enterprises; responsibilities of ministries, ministerial-level agencies, provincial-level local authorities, other agencies, organizations and individuals involved in legal support for small and medium-sized enterprises.

In order to carry out its assigned tasks, the Ministry of Industry and Trade has issued annual plans to provide legal support to small and medium-sized enterprises, aiming to unify the direction, management, implementation and coordination of legal support activities for small and medium-sized enterprises in the Industry and Trade sector, and actively carry out information and legal consulting activities for small and medium-sized enterprises within its management scope.

Specifically, the Ministry of Industry and Trade has built and announced a network of legal consultants and resolved procedures for supporting legal consultancy costs; built, managed, maintained, updated, exploited and used the legal database and legal support column for small and medium-sized enterprises on the electronic information portal of ministries and ministerial-level agencies, connecting to the Electronic Information Page providing legal support for small and medium-sized enterprises. Responded to legal problems for small and medium-sized enterprises within the scope of the industry and field under its management.

The Ministry of Industry and Trade has also developed and implemented a legal support program for small and medium-sized enterprises, and arranged human resources and funding to ensure legal support activities for small and medium-sized enterprises. Inspect, monitor, and survey the implementation of legal support activities for small and medium-sized enterprises; evaluate implementation results...

However, in the process of implementing legal support programs for small and medium enterprises, problems and obstacles have arisen related to funding for program and plan development.

In addition, limitations in the network of legal consultants and human resources for legal support for small and medium enterprises; difficulties in legal regulations... also affect the implementation of legal support activities for small and medium enterprises.

Accordingly, in order to bring regulations and policies on legal support for small and medium-sized enterprises into practice and bring practical benefits to enterprises, the Ministry of Industry and Trade believes that legal support for small and medium-sized enterprises in the coming time needs to innovate its working methods, adjust activities with focus and key points, closely follow the needs and development practices of small and medium-sized enterprises, and closely follow new trends and contexts.

At the same time, there needs to be cooperation from the Government , ministries, branches and localities in implementing synchronous solutions and perfecting the legal system on supporting small and medium enterprises.

In order to support and provide legal advice to small and medium-sized enterprises, the Ministry of Industry and Trade has provided public and transparent information on issues of interest to society and enterprises, and posted the contents of draft legal documents developed by the Ministry of Industry and Trade on the Ministry of Industry and Trade's Electronic Information Portal.
