On May 23, the Department of Food Safety ( Ministry of Health ) issued Official Dispatch No. 1078/ATTP-PCTTR to the Department of Health of provinces and centrally run cities; Department of Food Safety of Ho Chi Minh City; Da Nang Food Safety Management Board on the implementation of the peak month to fight against and repel smuggling, trade fraud, counterfeit goods, and infringement of intellectual property rights.
Accordingly, the dispatch signed by Deputy Director of the Department of Food Safety Chu Quoc Thinh stated that, in order to implement Official Dispatch No. 55/CD-TTg dated May 2, 2025 of the Prime Minister regarding handling cases of production and trade of fake medicines, fake milk and fake health protection foods; Plan No. 792/KH-ATTP dated April 19, 2025 of the Director of the Department of Food Safety implementing Official Dispatch No. 41/CD-TTg dated April 17, 2025 of the Prime Minister;
Telegram No. 65/CD-TTg dated May 15, 2025 of the Prime Minister on launching a peak period to fight against smuggling, trade fraud, counterfeit goods, and infringement of intellectual property rights and Directive No. 13/CT-TTg dated May 17, 2025 of the Prime Minister on strengthening the fight against smuggling, trade fraud and counterfeit goods in the new situation, the Food Safety Department requests departments, boards, and branches to urgently implement the following contents:
The Department of Health of provinces and centrally run cities, the Department of Food Safety of Ho Chi Minh City; and the Da Nang Food Safety Management Board shall proactively advise and coordinate with relevant units in the area to effectively implement the contents of Decision No. 1703/QD-BYT dated May 21, 2025 of the Ministry of Health on promulgating the Plan to implement the peak month of combating and preventing smuggling, trade fraud, counterfeit goods, and infringement of intellectual property rights.
Establish surprise inspection teams during the peak month from May 15, 2025 to June 15, 2025 to inspect the implementation of legal regulations related to trading, production and business activities of food products under the responsibility of the health sector in order to combat, prevent, repel and eventually end smuggling, trade fraud, production and circulation of counterfeit goods, and protect the rights and legitimate interests of people and businesses.
Along with that, establish a Working Group to review, rectify and handle advertising violations; require scientists and managers of the health sector to sign a commitment not to advertise or introduce false information, information lacking scientific basis or basis, or exaggerating the features and uses of products.
The Food Safety Department also requested the Department of Health of provinces and centrally-run cities; the Department of Food Safety of Ho Chi Minh City; and the Da Nang Food Safety Management Board to closely coordinate with functional agencies and management levels to promptly detect and strictly handle acts of production and trading of smuggled food products of unknown origin.
Enhance the effectiveness of management, especially licensing, testing, post-inspection, and certification of production eligibility, creating breakthrough changes in the prevention and combat of smuggling, trade fraud, and counterfeiting of food products.
At the same time, strengthen propaganda work to raise people's awareness of fraudulent tricks in the production and trading of counterfeit goods of unknown origin.
Set up 5 surprise inspection teams on production, import and trading of milk and functional foods
Previously, on May 22, in order to implement the direction of the Ministry of Health, the Department of Food Safety established 5 inspection teams to conduct surprise inspections of the implementation of food safety regulations at establishments producing, exporting, importing, and trading food ingredients, milk, and functional foods in the following provinces and cities: Hanoi, Bac Ninh, Dong Nai, Nam Dinh, and Thai Binh.
The list of inspected facilities is selected by the local Department of Health and Food Safety Department.
The inspection period is 45 working days from the date of announcement of the inspection decision. Inspection period: From January 1, 2024 to May 22, 2025. If necessary, relevant contents may be inspected before or after the inspection period.
The decision of the Food Safety Department clearly states: The inspection team is responsible for inspecting the implementation of legal provisions on food safety at establishments producing, exporting, importing, and trading food ingredients, milk, and functional foods according to the contents specified in Clause 1, Article 6 of Circular No. 48/2015/TT-BYT, amended and supplemented in Clause 4, Article 5 of Circular No. 17/2023/TT-BYT and related legal documents;
Perform the tasks and powers specified in Clause 2, Article 70 of the Law on Food Safety; handle and recommend handling during the inspection process; summarize and report inspection results according to regulations...
