However, up to now, the management of primitive weapons still has many shortcomings and lacks consistency between legal regulations. Therefore, the authorities need to have effective measures to manage primitive weapons, contributing to preventing violations of the law.
According to statistics from the Ministry of Public Security , after 5 years of implementing the Law on Management and Use of Weapons, Explosives and Supporting Tools in 2017 (effective from July 2018), out of a total of 28,715 cases of subjects illegally using weapons, explosives and supporting tools to commit murder, robbery, intentional injury, resisting law enforcement officers, and disturbing public order, up to 25,378 cases (accounting for 88.4%) used rudimentary weapons, knives and knife-like means to commit crimes.
In particular, the subjects used knives to commit crimes in 16,841/25,378 cases (accounting for 66.4%). Many cases involved subjects using sharp, highly lethal knives such as butcher knives, cleavers, machetes... to kill people in a very reckless, cruel, and savage manner, causing public outrage, confusion, and anxiety among the people.
On April 6, 2024, Dak Lak Provincial Police issued a decision to prosecute and temporarily detain Vu Quoc Son (residing in Thanh Nhat ward, Buon Ma Thuot city) for four months to investigate the act of murder.
Previously, on March 15, 2024, Son drove his motorbike to the house of an acquaintance in the same ward to drink. Here, Son met Mr. Phan Tien Cong. After finishing drinking, Son went to the living room to rest, Mr. Cong took a knife about 20 cm long, grabbed Son by the collar, threatened him, and slapped him. Out of anger, Son went into the kitchen, took a knife about 30 cm long, and stabbed Mr. Cong in the chest, seriously injuring the victim and causing him to die on the way to the hospital.
According to the Ministry of Public Security, the use of knives to commit crimes does not only occur in spontaneous personal conflicts, but in reality, the situation of teenagers forming gangs, converting sharp knives, welding long iron pipes to resolve conflicts, pay each other, and threaten people to rob property is happening in many localities.
Recently, Dong Hung District Police, Thai Binh Province, issued a decision to prosecute a criminal case, prosecute the accused, and temporarily detain four subjects, including Tran Huu Quang, Tran Trung Hieu, Tran Van Chien (all residing in Group 2, Ky Ba Ward, Thai Binh City) and Dam Gia Long (residing in Group 6, Tran Hung Dao Ward, Thai Binh City) for robbery. Previously, on the evening of March 7, 2024, Dong Hung District Police received a report from Pham Tien Th. (residing in Phu Vinh Village, Minh Phu Commune, Dong Hung District) about being robbed of property. At about 8:00 p.m. on March 7, on the dike road in Phuong Cuc Village, Dong Duong Commune, Dong Hung District, Th. was driving a Honda Wave 50cc motorbike from Thai Binh City to Dong Duong Commune when four young men on two motorbikes without license plates traveling in the same direction overtook him from behind, blocked his vehicle, threatened him with a knife, and demanded that he hand over all his property. The two subjects then searched Th. but found no property so they left. Th. continued to walk for about 300m before the subjects stopped him and robbed his motorbike.
Not only using knives to commit robberies and disrupt public order, many subjects also boldly used knives to attack the forces on duty, causing a number of police officers and soldiers to be injured or killed. On January 17, 2024, Thua Thien Hue Provincial Police issued a decision to prosecute the case, prosecute the accused, and temporarily detain Nguyen Tan Sang (born in 1999, residing in Thuy Van ward, Hue city) for murder.
Previously, at around 5:00 p.m. on January 12, after receiving information that Nguyen Tan Sang was blocking traffic on Le Duc Anh Street, Thuy Van Ward, endangering traffic participants, Captain Tran Duy Hung, Deputy Chief of Thuy Van Ward Police, Lieutenant Duong Van Minh Hieu, and the neighborhood watch quickly arrived at the scene to persuade, remind, and ask Sang to return home. However, Sang did not comply with the police's request and had an aggressive attitude, scuffling with the police. The working group took the subject away from Le Duc Anh Street, near the house gate.
At this time, the subject ran into the house and ran out holding a sharp knife to attack the Working Group. Faced with the dangerous behavior of Sang, Captain Tran Duy Hung and other comrades approached, controlled, and arrested the subject. During the course of performing the task, approaching the subject, Captain Tran Duy Hung was stabbed many times in the neck and chest by the subject. Although he was given emergency treatment by doctors and nurses from Hue Central Hospital, Captain Tran Duy Hung did not survive due to severe injuries.
According to the Ministry of Public Security, currently, the rate of crimes using knives to commit crimes is very high, many cases of subjects using sharp, pointed knives with high lethality, committing crimes with very reckless nature. However, the current Law on Management and Use of Weapons, Explosives and Support Tools does not stipulate that knives are weapons, so it cannot handle subjects for the act of storing and illegally using weapons.
Meanwhile, Article 306 of the 2015 Penal Code (amended and supplemented in 2017) stipulates that criminal prosecution will only be applied for the crime of manufacturing, storing, transporting, trading, illegally using or appropriating primitive weapons when the subject has been administratively sanctioned for this act, or has been convicted of this crime, and has not had his criminal record expunged. The above shortcomings have caused great difficulties in the management of primitive weapons, as well as in the process of detecting and handling acts of storing this type of weapon.
The Ministry of Public Security is drafting the Law on Management and Use of Weapons, Explosives and Support Tools (amended), in the direction of including highly lethal knives in the group of primitive weapons for management. However, many opinions say that knives are highly lethal, but are also dual-purpose tools, commonly used by people in labor, production and daily life. Therefore, if there are no specific regulations, it will affect people's social life.
Legal experts say that, in addition to researching to propose effective management measures for highly lethal weapons such as knives to improve the effectiveness of crime prevention and combat, it is necessary to strengthen propaganda and education work, raise people's awareness of law compliance. Along with that, strengthen inspection and control to promptly detect and prevent violations of the law, contributing to ensuring social order and safety.
