It is necessary to soon complete legal policies on preferential treatment for people with revolutionary contributions.

Continuing the program contents of the 10th Session, 15th National Assembly, on the afternoon of November 29, discussing in the hall about evaluating the results of implementing the socio-economic development plan, National Assembly delegate (NA) Vuong Thi Huong, NA Delegation of Tuyen Quang province, participated in discussing a number of contents related to preferential policies for people with revolutionary contributions.

According to the delegate, currently, the whole country has over 9.2 million people with meritorious services and relatives of people with meritorious services to the revolution, of which about 1.1 million people with meritorious services are receiving monthly allowances. Along with ensuring full and timely payment of regular allowances, the State has issued and synchronously implemented many practical support policies such as health rehabilitation; priority in enrollment, job creation; preferential loans for production and business; housing support for people with meritorious services and relatives of martyrs.

The Ordinance on Preferential Treatment for People with Meritorious Services to the Revolution No. 02/2020/UBTVQH14 issued by the National Assembly Standing Committee in 2020 is the document with the highest legal value in this field today. However, through practical implementation, it has shown that there are still many shortcomings and problems that need to be further improved. Some legal documents have not fully regulated the subjects entitled to preferential treatment according to practical developments; there is no consistency between Ordinance No. 02 and Decree No. 131/2021/ND-CP of the Government , leading to difficulties in organizing implementation at the local level.

The delegate pointed out that, regarding the content and conditions for enjoying the regime, Decree 131/2021/ND-CP has additional provisions compared to the Ordinance, narrowing the scope of benefits, causing difficulties and creating administrative procedures for people. Some regulations on the care regime at the facility or the authority to prepare records are still unclear, leading to confusion in implementation by localities. In addition, the monthly subsidy level of some subjects is not suitable for practice; with the same rate of physical injury, people with meritorious services have a lower benefit level than social protection subjects; the support level for providing assistive devices and orthopedic devices has remained the same since 2018, not keeping up with the preferential subsidy standard which has increased by 36%.

Delegate Vuong Thi Huong also paid special attention to the policy for the third generation of resistance fighters affected by toxic chemicals. According to data, there are currently more than 35,000 third-generation victims and more than 6,000 fourth-generation victims. Most of the victims are in difficult circumstances, have poor health, and have to live dependently, while the current Ordinance only stipulates policies for the second generation (biological children). The third generation has not been recognized as a preferential treatment for meritorious people, and only enjoys social protection under the Law on Persons with Disabilities, with a low level of support that does not meet minimum needs.

Delegates recommended that the Government should research, develop and promulgate the Law on Incentives for People with Revolutionary Contributions to replace the current Ordinance, in order to perfect the legal system in a unified, synchronous, feasible direction, suitable to practical requirements and the spirit of Resolution No. 42-NQ/TW dated November 24, 2023 of the 13th Party Central Committee on innovation and improvement of the quality of social policies.

At the same time, research and supplement policies for relatives of those affected by third-generation chemical agents of resistance war participants, ensuring fairness and humanity in policy enjoyment, demonstrating the responsibility of the State and society in overcoming the severe consequences of war, in accordance with the spirit of Directive No. 14-CT/TW dated July 19, 2017 of the Secretariat.

Along with that, balancing the budget, continuing to adjust preferential subsidies for meritorious people at the highest level in the social policy system, aiming for the goal that by 2030, 100% of meritorious people and their families will have an average or higher standard of living, and will be comprehensively cared for both materially and spiritually, contributing to the successful implementation of sustainable development goals set by the Party and State.
