Recently, there have been a series of cases of broken savings and credit association, or of fraudulent appropriation of property by the owners of savings and credit associations nationwide, causing many people to lose their property, with the amount of money stolen amounting to billions of dong. Although the authorities regularly propagate and warn, the cases of broken savings and credit association still occur. This is because many participants lack vigilance, do not clearly understand the legal regulations, rights, obligations and related legal responsibilities, and are still subjective when participating in savings and credit associations.

Recently, the Investigation Police Agency, Ly Nhan District Police, Ha Nam Province has issued a decision to prosecute a criminal case and prosecute the accused Doan Thi Sang (born in 1983), residing in Village 1, Chinh Ly Commune, Ly Nhan District, Ha Nam Province for fraud and property appropriation.

By taking advantage of the trust of people who wanted to play with them and the fact that the players in the clans did not know each other, Sang established clans to collect money.

Due to financial imbalance and no longer being able to pay them, Sang committed fraud by impersonating the person who wanted to buy them in the periods so that he could take them in those periods to appropriate the property.

Using the above tricks, before fleeing the locality, Sang set up 27 clan lines, luring more than 800 people to play (equivalent to more than 1,300 clan positions) to appropriate property.

At the investigation agency, Doan Thi Sang admitted: "Because my business was losing money, most of the people who came to buy my family names already had deposit slips, so I took them. After I realized I could no longer pay the owners, I fled the area."

Hui, they operate based on trust, self-control mechanism, usually the person who controls and operates is the owner of the group. Most participants lack vigilance, do not clearly understand the legal regulations, rights, obligations and related legal responsibilities.

As one of many people who participated in paying for Doan Thi Sang, Ms. Pham Thi Ngoc said, “Every month, my family has been saving money to contribute 8 portions of the family, the total amount I paid is 241 million and 20 thousand Dong. By March 2024 of the lunar calendar, Ms. Sang and her husband had fled the locality. Now, my family is very confused and worried, not knowing when we will get back the money they contributed.”

Hui, they are a type of capital mobilization for loans, savings in a voluntary form, with little publicity between the subjects, operating based on trust and personal, voluntary relationships. The owner does not need collateral, nor does he provide full information to the participants. Although the law has stipulated that to participate in a hui, they must agree in writing and can request notarization, but in reality, the participants mainly agree orally, with handwritten documents. While the number of participants is large, they know little about each other, have little information about the economic conditions and purposes of the owner of the hui, hui.

In reality, most of the people in the localities who participate in gambling are low-income workers, small businesses... pooling their family's monthly savings to gamble, even borrowing money to contribute.

However, taking advantage of this, many owners have defrauded and appropriated property, causing many members to be "empty-handed", falling into debt, losing property, at least tens of millions of dong, at most up to billions of dong, causing significant impact on security and order in the locality and causing public outrage.

Discussing this issue, Major Nguyen Duc Thao, Deputy Head of the General Investigation Team, Ly Nhan District Police, Ha Nam Province warned: When people need to borrow money or deposit savings, they should go to credit institutions such as banks, avoid playing the hui because it has a very high risk of hui failure and a great risk of losing money.

From the recent cases of loan defaults occurring across the country in general and Ha Nam province in particular, the Public Security Department recommends that in order to avoid being scammed and losing property, affecting the daily life of each family, people should choose appropriate and safe forms of investment, savings and accumulation, avoiding participating in high-risk savings and accumulation groups, which pose a risk of having their property seized; at the same time, they must have a firm grasp of the legal provisions related to capital contribution, to both ensure their legitimate rights and interests and avoid risks.
