Details to note in the new Regulations on transporting children in cars

According to the Traffic Police Department, passenger transport vehicles will not have to use child safety equipment, to ensure feasibility and to suit practical traffic conditions in Vietnam.

On the afternoon of December 2, the Traffic Police Department ( Ministry of Public Security ) informed that the Government has adjusted regulations related to the use of safety devices for children in cars in the draft Law amending and supplementing a number of articles of 10 laws related to security and order. The amended content was proposed after receiving comments from National Assembly deputies to ensure feasibility during the implementation process.

According to the latest draft, when transporting children under 10 years old and under 1.35m tall, the driver must not let the child sit in the same row of seats as the driver, except in cases where the vehicle has only one row of seats. At the same time, the driver is responsible for using or instructing the child to use appropriate safety equipment. However, this regulation does not apply to passenger transport vehicles.

The Traffic Police Department believes that the exemption for passenger transport vehicles is necessary because this type of vehicle is difficult to install specialized equipment for children; at the same time, it is suitable for the reality of transport activities in Vietnam.

Child safety devices as prescribed are products that help secure children in a safe sitting or lying position in a car, capable of reducing injuries in the event of a collision or when the car brakes suddenly. This group of devices includes specialized seats, cradles, booster cushions... combined with seat belts that are tightly attached to the car body.

The draft Law amending and supplementing a number of articles of 10 laws related to security and order is being submitted to the 15th National Assembly at the 10th session and is expected to take effect from January 1, 2026.
