The Government stated the reason for proposing to assign commune-level chairmen to mobilize and transfer teachers.

Minister of Education and Training Nguyen Kim Son signed the Government 's report on receiving, explaining, and revising the National Assembly's draft resolution on a number of specific and outstanding mechanisms and policies to make breakthroughs in education and training development.

Ensure flexibility and suitability in management work in the area

Notably, the draft stipulates that the Director of the Department of Education and Training exercises the authority to recruit and receive teachers, managers of educational institutions and staff in preschool teacher training institutions, general education, continuing education, specialized schools and public vocational high schools (public educational institutions) in the province.

Exercise the authority to mobilize, transfer, second, appoint, change job positions, arrange and assign tasks to teachers, educational institution managers and staff in public educational institutions under its management authority and to public educational institutions related to the scope of 2 or more commune-level administrative units in the province.

The Chairman of the People's Committee at the commune level exercises the authority to mobilize, transfer, second, appoint, change job positions, arrange and assign work to teachers, educational institution managers and staff in public educational institutions under his/her management authority.

During the discussion, there were concerns that decentralization, assigning the Chairman of the People's Committee at the commune level to mobilize and transfer human resources in the education sector within the scope of their management authority, would be difficult to ensure close connection with professional management.

Explaining this content, the Government said that according to the provisions of the Law on Organization of Local Government and current regulations on decentralization of authority, the authority has been assigned to the Chairman of the People's Committee at the commune level to manage tasks related to preschool education and lower secondary education.

Therefore, assigning the Chairman of the People's Committee at the commune level to mobilize and transfer education personnel within the scope of management authority will ensure flexibility and suitability in management work in the area.

Besides, the mobilization and transfer must still ensure the selection of the right human resources for the right job position according to job position standards.

The Government also emphasized that the recruitment of education personnel in the province will be carried out according to the plan based on review and proposals from the commune and ward levels.

The Director of the Department of Education and Training will allocate human resources to communes to ensure consistency and avoid local surplus or shortage of teachers.

The capacity of the Department of Education and Training to meet the organization's recruitment of teachers

Regarding the capacity of the Department of Education and Training to meet the organization of teacher recruitment, the Government's report clearly states that the department is a specialized agency on education and training under the provincial People's Committee.

Every year, the focal point conducts many major industry exams across the province such as national high school graduation exams, 10th grade entrance exams, and excellent student exams at all levels.

The human resources of the Department of Education and Training as well as the team of experts who are managers and experienced teachers that can be mobilized to conduct the exam are very large, completely meeting the requirements of a large recruitment period.

The report cited that the Ho Chi Minh City Department of Education and Training completed the teacher recruitment in the entire city after the merger in 2 months (October and November 2025), with the number of qualified candidates reaching 10,000 people.

Meanwhile, at the current commune level, according to a quick survey by the Ministry of Education and Training, most localities have not arranged enough specialized human resources in charge of education and training at the social and cultural departments (only about 30% of commune-level civil servants in charge of education and training currently have specialized education or have experience in education).

In addition, the Ministry of Education and Training has posted a draft circular regulating the authority to recruit teachers on the Ministry's electronic information portal and sent a document asking for opinions from ministries, agencies and localities on the draft circular.

Currently, the Ministry of Education and Training is synthesizing comments from ministries, branches, and localities. Through synthesizing comments from 31/34 provinces and cities, 27 localities assigned the Department of Education and Training to be the focal point, presiding over coordination with departments, branches, communes, wards, and special zones. There are 4 localities directly submitting written comments to the People's Committee.

Of which, 31/31 localities agreed to assign the Department of Education and Training to recruit teachers in high schools, regular and specialized education.

Regarding the authority to recruit teachers in educational institutions from preschool, primary and secondary schools, 27/31 localities agreed to assign the recruitment department.

The People's Committee of Dong Thap province and two communes of Quang Tri province proposed to assign the Chairman of the People's Committee at the commune level; the Department of Home Affairs of Ninh Binh province, the Department of Education and Training of Quang Ninh, Son La, and Quang Ngai provinces proposed to review to ensure compliance with the Law on Organization of Local Government.

In addition, following the procedure, on November 28, 2025, the Ministry of Education and Training submitted a document requesting the Government's opinion on the draft resolution.

Based on the submission, the Government Office sent a ballot to collect comments from Government members on the draft in the submission. Accordingly, the Ministry of Home Affairs agreed and had no other opinions on this content.
