Government Inspector General: "Do not allow the delegation of deputy level to receive citizens"

On the afternoon of December 5, the National Assembly discussed in the hall the draft Law amending and supplementing a number of articles of the Law on Citizen Reception, the Law on Complaints, and the Law on Denunciation.

Expressing his views on the form of citizen reception, delegate Nguyen Tam Hung (HCMC) supported the addition of the form of online citizen reception and proposed to clearly stipulate that "the legal value of online citizen reception is equivalent to direct citizen reception".

Along with that, the delegate said that there should be a mechanism to bind the personal responsibility of the leader in case of delay or avoidance of receiving citizens, prolonging the time limit for settlement, or transferring petitions in a roundabout way. "Practice shows that many cases of complaints and denunciations that last a long time do not stem from the complexity of the case but from the avoidance of responsibility," Mr. Hung said.

Meanwhile, delegate Hoang Anh Cong ( Thai Nguyen ) proposed reviewing regulations on the protection of whistleblowers and prohibited acts of the Law on Denunciation and related laws for research and appropriate adjustment.

Explaining later, Government Inspector General Doan Hong Phong said that the agency in charge of drafting the bill agreed with the opinions of National Assembly deputies on cases of online citizen reception, building a national database on citizen reception, organization methods, ensuring safety, security and information storage.

The drafting agency will absorb these contents and stipulate them in the Government's decree guiding the implementation of the law, according to the Inspector General.

He also said that the agency in charge of drafting the law accepted the opinion of delegate Tuan on suspending the settlement of complaints in cases of force majeure. This content, according to the Inspector General, will be reflected in the Government's decree guiding the implementation of the law.

Regarding the protection of whistleblowers, the Inspector General affirmed that the current Law on Denunciation has full provisions, including: protection of information, job position, life, administrative handling, handling of retaliation against whistleblowers...

In addition, some delegates suggested adding a mechanism to authorize deputies, expanding the subjects of citizen reception, and regulating the establishment of citizen reception committees at the commune level.

Inspector General Doan Hong Phong explained that this draft law continues to inherit the current regulation, which is "not allowing the delegation of citizen reception authority to deputies", in order to enhance the direct responsibility of the head.

He also affirmed that current laws have fully regulated the subjects of citizen reception at all levels, sectors, agencies, units, socio-political organizations, etc.

“To avoid the emergence of new organizations and to be consistent with the Party and State's policy on streamlining the organizational apparatus, the draft law does not add a model of a commune-level citizen reception committee, but instead arranges a civil servant unit belonging to a suitable unit of the commune People's Committee to perform the task of receiving citizens and resolving complaints and denunciations,” the Inspector General explained.

According to the agenda, the National Assembly will vote to pass the Law amending and supplementing a number of articles of the Law on Citizen Reception, the Law on Complaints, and the Law on Denunciations on December 11.
