Comments on the Draft Resolution to remove difficulties in implementing the Law on Geology and Minerals

On July 25, Deputy Prime Minister Tran Hong Ha chaired a conference to listen to and comment on the Government's Draft Resolution on promulgating specific mechanisms and policies to remove difficulties in implementing the Law on Geology and Minerals in 2024. The conference was connected online to 15 provinces and centrally-run cities.

Attending the conference at the Tuyen Quang province bridge were leaders of the province's departments and branches.

Based on the Submission of the Ministry of Agriculture and Environment , the Draft Resolution proposes specific mechanisms and policies to remove difficulties in implementing the Law on Geology and Minerals in 2024.

In which, the granting of licenses for deep exploration and expansion as prescribed in Point d, Clause 2, Article 4 of the Law on Geology and Minerals is not based on mineral planning or management plans on geology, minerals, components in the plan for environmental protection, exploitation, use, protection of resources, biodiversity, prevention and control of natural disasters and response to climate change in the area are integrated into the provincial planning.

Permission to exploit group IV minerals to serve construction works, projects and tasks is applied according to the principles of granting licenses to exploit group IV minerals prescribed in Point d, Clause 2, Article 73 of the Law on Geology and Minerals.

Allows the adjustment of mineral exploitation licenses to increase the exploitation capacity of group III minerals for common construction materials, group IV minerals for mineral mines with valid mineral exploitation licenses to serve works, projects, and tasks. Allows the exemption from procedures for mineral exploration licenses, recognition of mineral exploration results, mineral exploitation licenses for group III minerals, group IV minerals, issuance of mineral recovery registration certificates when responding to emergency situations related to natural disasters, epidemics, security, national defense, etc.

Discussing at the conference, delegates said that the issuance of the Resolution on special policy mechanisms to remove difficulties in implementing the Law on Geology and Minerals in 2024 is consistent with the spirit of Resolution No. 206/2025/QH15 of the 15th National Assembly on special mechanisms to handle difficulties and obstacles due to legal provisions.

Concluding the conference, Deputy Prime Minister Tran Hong Ha stated: The issuance of the Government's Resolution on promulgating specific mechanisms and policies to remove difficulties in implementing the Law on Geology and Minerals 2024 is to solve urgent and immediate problems. It is expected that the contents of the resolution will only be implemented until February 28, 2027. The Deputy Prime Minister noted that the process of implementing the resolution's contents is linked to the policy of decentralization and delegation of power. Therefore, when the resolution comes into effect, localities must proactively develop plans and implementation plans and take responsibility for performing assigned tasks, ensuring ecological environmental safety, planning, and best serving the socio-economic development goals.
