Comments on the Draft Resolution to remove difficulties in implementing the Law on Geology and Minerals

On July 25, Deputy Prime Minister Tran Hong Ha chaired a conference to listen to and give opinions on the Government's Draft Resolution on promulgating specific mechanisms and policies to remove difficulties in implementing the Law on Geology and Minerals in 2024. The conference was connected online to 15 provinces and centrally-run cities.

Based on the Submission of the Ministry of Agriculture and Environment , the Draft Resolution provides specific mechanisms and policies to remove difficulties in implementing the Law on Geology and Minerals in 2024.

In particular, the granting of licenses for deep exploration and expansion as prescribed in Point d, Clause 2, Article 4 of the Law on Geology and Minerals is not based on mineral planning or geological and mineral management plans, components in environmental protection plans, exploitation, use, protection of resources, biodiversity, prevention and control of natural disasters and response to climate change in the area are integrated into the provincial planning.

Permission to exploit Group IV minerals to serve construction works, projects and tasks is applied according to the principles of granting licenses to exploit Group IV minerals prescribed in Point d, Clause 2, Article 73 of the Law on Geology and Minerals.

Allowing the adjustment of mineral exploitation licenses to increase the exploitation capacity of Group III minerals for common construction materials, Group IV minerals for mineral mines with valid mineral exploitation licenses to serve works, projects, and tasks. Allowing the exemption from carrying out procedures for mineral exploration licenses, recognition of mineral exploration results, mineral exploitation licenses for Group III minerals, Group IV minerals, and issuance of certificates of registration for mineral recovery when responding to emergency situations related to natural disasters, epidemics, security, national defense, etc.

Discussing at the conference, delegates said that the issuance of the Resolution on specific policy mechanisms to remove difficulties in implementing the Law on Geology and Minerals in 2024 is consistent with the spirit of Resolution No. 206/2025/QH15 of the 15th National Assembly on special mechanisms to handle difficulties and obstacles due to legal provisions.

Concluding the conference, Deputy Prime Minister Tran Hong Ha stated: The issuance of the Government's Resolution on promulgating specific mechanisms and policies to remove difficulties in implementing the Law on Geology and Minerals 2024 is to solve urgent and immediate problems. It is expected that the contents of the resolution will only be implemented until February 28, 2027. The Deputy Prime Minister noted that the implementation process of the resolution is associated with the policy of decentralization and delegation of power. Therefore, when the resolution comes into effect, localities must proactively develop plans and implementation plans and take responsibility for performing assigned tasks, ensuring ecological and environmental safety, planning, and best serving the goals of socio-economic development.
