The National Assembly passed the Law on Road Traffic Order and Safety on June 27th. The law consists of 9 chapters and 89 articles, and will come into effect on January 1st, 2025.
Notably, Clause 4 of Article 62 of this law on the issuance, exchange, re-issuance, and revocation of driver's licenses stipulates that driver's licenses will not be issued or exchanged to individuals who have not yet paid traffic violation fines.
Specifically, a driver's license is only issued to those who pass the driving test. The content of the driving test must be appropriate for the license category and the driver training program. Driving tests for automobiles must be conducted at driving test centers; driving tests for motorcycles must be conducted at driving test centers or at driving practice areas that meet the required conditions and standards regarding facilities and technical equipment.
Drivers' licenses can be renewed or reissued in the following cases: lost license; damaged license rendering it unusable; according to the expiration date on the license; changes to the information on the license; valid foreign driver's licenses issued by competent foreign authorities; driver's licenses issued by the Ministry of National Defense or the Ministry of Public Security upon request or when the license holder is no longer serving in national defense or security.
Clause 4 of Article 62 also stipulates: Driving licenses shall not be issued, exchanged, or reissued to individuals who violate road traffic order and safety until they have completed the requirements of the competent State agency regarding the resolution of the administrative violation in the field of road traffic order and safety.
Therefore, from January 1, 2025, if a driver violates road traffic safety regulations and is fined but has not paid the fine, they will be refused the issuance, renewal, or re-issuance of their driver's license. Only after paying the administrative fine will the issuance, renewal, or re-issuance of the driver's license be processed.
