The Department of Construction of Da Nang City has just announced projects eligible for capital mobilization. Accordingly, the Lang Van Tourism and Urban Resort Complex in Hai Van Ward of Vinpearl Joint Stock Company mobilized capital of 16,850 billion VND; Thuan Phuoc - Da Nang New Urban Area in Son Tra Ward of Thuan Phuoc Bay Urban Investment Joint Stock Company mobilized capital of 2,139 billion VND; The Legend City Danang Trade Center, Hotel and Apartment Complex in An Hai Ward of Vipico LLC mobilized capital of 1,764 billion VND; Thuy Tu Urban Tourism Infrastructure Construction Project (Phase 2) in Hai Van Ward of Finance and Enterprise Development Joint Stock Company mobilized capital of 800 billion VND; Northwest Model Urban Area Project - Phase 1 in Ban Thach Ward of Northwest Real Estate Trading Joint Stock Company mobilized capital of 651 billion VND.
According to the Department of Housing and Real Estate Market Management, Khanh Hoa Province Department of Construction, parties participating in capital contributions, investment cooperation, business cooperation, joint ventures, and associations are only allowed to divide profits in cash or shares based on the capital contribution ratio as agreed in the contract.
Investors are not allowed to divide housing products or to give priority to registration, deposit, or right to purchase housing or to divide land use rights in the project to the capital mobilized party, except in the case of contributing capital to establish a new legal entity to be assigned by the State as the investor of a housing construction investment project according to the provisions of law.
Investors must use mobilized capital for the purpose of developing housing and implementing housing construction investment projects, and may not use mobilized capital for other projects or other purposes.
In case the project investor has mortgaged part or all of the project or mortgaged the housing in the project and has registered the mortgage according to regulations, but mobilizes capital to invest in the construction of the mortgaged part of the project or housing, it must carry out the procedure of removing the mortgage registration or withdrawing the mortgaged assets according to the provisions of law on registration of security measures before signing the capital mobilization contract according to the provisions of Clause 4, Article 43 of Decree No. 95/2024/ND-CP of the Government.
The investor ensures that the total capital mobilized in various forms and the owner's equity must not exceed the total investment capital of the project, including land use fees and land rents that the investor must pay according to the provisions of the law on land as prescribed in Clause 4, Article 43 of Decree No. 95/2024/ND-CP of the Government.
