Commenting on the amendment and supplementation of a number of articles of the Investment Law, Comrade Ma Thi Thuy, member of the Provincial Party Committee, Deputy Head of the Provincial National Assembly Delegation, said that the form of selecting investors to implement technical infrastructure projects for industrial clusters has not been stipulated in the draft Investment Law. Meanwhile, Decree No. 32/2024/ND-CP of the Government on the management and development of industrial clusters, investment projects to build technical infrastructure for industrial clusters must carry out both the procedures for approving investment policies and the procedures for establishing industrial clusters.

Delegates proposed to supplement specific regulations on the order and procedures for selecting investors to implement investment projects to build technical infrastructure for industrial clusters using investors' capital to ensure consistency between the Investment Law 2020 and Decree No. 32/2024/ND-CP.

In addition, the Investment Law 2020 stipulates documents proving the financial capacity of investors but does not stipulate the minimum equity ratio to ensure the ability to mobilize capital to implement investment projects, so there is no basis for appraisal. It is proposed to add specific regulations on the minimum equity ratio as a basis for assessing the financial capacity of investors, ensuring the mobilization of consistent resources between projects.

Regarding special investment procedures, delegates proposed to add regulations listing regulations related to the fields of construction, environmental protection, technology transfer, and fire prevention and fighting, to amend in the direction of excluding investment projects listed in Clause 1, Article 36a in related procedures.

Delegate Lo Thi Viet Ha, Standing Member of the National Assembly 's Social Affairs Committee, proposed to supplement regulations on special preferential policies for investment in the development of the pharmaceutical industry, in order to remove difficulties and obstacles in attracting investment in this field. According to the delegate, previously, the investment level was too high, so there were no enterprises investing in the pharmaceutical industry in Vietnam. Therefore, lowering the investment level of the project will attract investment and develop the pharmaceutical industry, so that people can benefit from policies related to the pharmaceutical industry, especially meeting the requirements of pharmaceutical industry development in the coming time...

Regarding the content of amending and supplementing a number of articles of the Law on Bidding, delegate Ma Thi Thuy proposed to add specific regulations on the ratio of medium-term capital allocated to the project compared to the total investment of the project. The delegate also suggested to review the regulations in Point 5, Clause 12, Article 4 to ensure the rights of contractors when conducting bidding.

Agreeing with the opinions of the delegates, Comrade Au Thi Mai, Member of the Provincial Party Committee, Director of the Department of Culture, Sports and Tourism, proposed that the Drafting Committee study and amend the regulations on bidding, selection of contractors to provide consulting services, non-consulting services, and a number of other regulations to remove obstacles and increase competitiveness in bidding.

At the same time, it is proposed to consider adding regulations on bidding in special cases for art programs. The delegate also requested the Drafting Committee to specify cases of changing the capital contribution ratio in the joint venture of investors implementing the project. According to the delegate, although there are currently no specific regulations, in reality, there are many projects where investors request to change the capital contribution ratio in the joint venture or investors request to withdraw from the joint venture.

Regarding the amendment and supplementation of a number of articles of the Law on Planning, delegate Au Thi Mai proposed to add regulations on mobilizing legal capital sources to implement the costs of establishing, appraising, and adjusting planning tasks; appraising; evaluating; adjusting planning according to the order and procedures of shortening national planning, regional planning, provincial planning...

Regarding the order, procedures and authority to adjust the planning according to the shortened order and procedures, the delegate suggested that the Drafting Committee consider removing the provision on reporting to the Prime Minister for approval of the planning adjustment policy in the cases specified in Points b and c, Clause 2 of this Article before preparing the planning adjustment dossier and sending it to relevant agencies for comments, because it is inconsistent with Point c, Clause 1, Article 2 of Resolution No. 61/2022/QH15 dated June 16, 2022 of the National Assembly.

Comments on the Resolution   Regarding the pilot handling of evidence and assets during the investigation, prosecution and trial of a number of criminal cases, delegate Nguyen Viet Ha, Director of the Bank for Agriculture and Rural Development, Tuyen Quang province branch, delegate said that the draft defines the concept of a criminal case as subject to interpretation, and there are no provisions explaining criminal cases, while there are many in the Penal Code, so it is suggested that consideration be given to explaining the scope.

Regarding measures to handle property evidence, Clause 1 stipulates returning money to the victim or depositing money in a bank pending processing. The delegate proposed to reconsider, because credit institutions, including non-bank credit institutions, do not have the function of receiving deposits. Therefore, it is necessary to ensure clarity during the implementation process when stating "credit institutions", while the regulations below all state that they are commercial banks.

Delegates also requested to clarify the regulations on depositing security to cancel the seizure, temporary detention, attachment, and blockade and the regulations on handing over evidence and assets to the legal owners and managers for management, exploitation, and use...
