Specifically, in the Progress Report on the implementation of the contents of responding to voters' opinions that are still pending and have not been completely resolved according to the request of the Standing Committee of the Provincial People's Council, according to the Provincial People's Committee, the Department of Natural Resources and Environment has issued Official Dispatch No. 359, dated March 8, 2021 on coordination and review of planned land; land allocated and leased but not planted with rubber trees to establish procedures for handing over to local management according to legal regulations, in which Quang Nam Rubber One Member Co., Ltd. is instructed to register to work with the People's Committee of Nong Son district to organize inspection and review of the area of land that has not been implemented within the scope of land planned for rubber planting approved by competent state agencies.
Based on the review results, the Nong Son District People's Committee directed the Department of Natural Resources and Environment to advise the District People's Committee to report, propose, and recommend handling to the Department of Natural Resources and Environment to coordinate with the Department of Agriculture and Rural Development to synthesize, review, and report to the Provincial People's Committee for consideration and direction. Up to now, the Nong Son District People's Committee has not yet sent any reports, proposals, or recommendations to the Department of Natural Resources and Environment to synthesize, report to the Provincial People's Committee for consideration and direction of handling according to regulations.
Quang Nam Rubber One Member Co., Ltd. has established a technical design plan - cost estimate for measuring and adjusting cadastral maps at a scale of 1/5,000 and registered and granted certificates of land use rights for rubber plantations in Hiep Duc, Nong Son, and Phuoc Son districts, which were appraised by the Department of Natural Resources and Environment in Official Dispatch No. 234 dated January 27, 2022.
Currently, the company is hiring a consulting unit to conduct cadastral map measurement and correction to establish procedures to resolve existing problems in the company's land management and use process according to regulations.
The Department of Natural Resources and Environment also inspected the compliance with land laws of Quang Nam Rubber One Member Co., Ltd. in implementing the rubber tree planting project in Nong Son and Phuoc Son districts.
The Department of Natural Resources and Environment issued Inspection Conclusion No. 543, dated August 8, 2022 on compliance with land laws for Quang Nam Rubber One Member Co., Ltd. and the Provincial People's Committee issued Official Dispatch No. 5368, dated August 15, 2022 on handling the inspection conclusion on compliance with land laws for Quang Nam Rubber One Member Co., Ltd.
Accordingly, the Provincial People's Committee requested the company: "For the land area not planted with rubber, the company must urgently complete procedures to remove it from the planning and adjust the planning of the rubber growing area accordingly; sign a contract with a functional unit to conduct measurements, complete procedures to return the overlapping land area that is no longer needed according to the provisions of Point a, Clause 1, Article 65 of the 2013 Land Law and hand it over to the People's Committees of Nong Son and Phuoc Son districts and the People's Committees of related communes for management and use in accordance with regulations".
Up to now, according to the report, the Department of Natural Resources and Environment has not received any application for land return due to no longer needing to use from Quang Nam Rubber One Member Co., Ltd. and Quang Nam Rubber Farm and Forestry Company in Nong Son and Phuoc Son districts.
Therefore, the Department of Natural Resources and Environment is requested to urge Quang Nam Rubber One Member Co., Ltd. and Quang Nam Rubber Farm and Forestry Company to urgently implement the direction of the Provincial People's Committee in Official Dispatch No. 5368, dated August 15, 2022 to complete procedures to return overlapping land areas and land no longer in need of use, and hand them over to local authorities for management and use according to regulations.
