Proposal that income fluctuations of 1 billion VND or more must be declared and assets must be explained as criteria for evaluating officials

On the morning of November 4, Government Inspector General Doan Hong Phong, authorized by the Prime Minister, presented a draft law amending and supplementing a number of articles of the Law on Anti-Corruption.

According to the Government Inspector General, the draft law focuses on perfecting policies on corruption prevention measures, including: assessment of corruption prevention and control work; asset and income control agencies; asset and income declaration and verification of assets and income.

The draft also clearly stipulates the authority of inspection agencies in inspecting cases with signs of corruption; receiving and handling feedback and denunciations about corruption. Regulations on the application of information technology, digital transformation, and the construction of a national database on asset and income control to prevent corruption are also supplemented.

Adjust the declared asset value level

According to Inspector General Doan Hong Phong, the draft law stipulates that the agencies controlling assets and income include: Inspection Committees of Party Committees at the grassroots level and above; Government Inspectorate; Supreme People's Court, Supreme People's Procuracy, State Audit, Office of the National Assembly, Office of the President, National Assembly Delegation Work Committee, Central agencies of socio-political organizations; Ministries, ministerial-level agencies, agencies under the Government; Inspectorates of provinces and centrally run cities.

Notably, the value of assets that must be declared is adjusted to increase from 50 million to 150 million VND; the value of assets and income that must be declared additionally when there is an increase in fluctuation during the year is increased from 300 million to 1 billion VND. This regulation is to be consistent with the conditions of socio-economic development and prices that have increased significantly compared to 2018.

Accordingly, the asset and income control agency monitors changes in assets and income of those required to declare through analyzing and evaluating information from the declaration or from other sources.

In case of detecting that assets and income have fluctuated by 1 billion VND or more during the year but the person who is obliged to declare has not declared, the agency controlling assets and income shall request that person to provide and supplement information. In case of increasing assets and income, the origin of the increased assets and income must be explained.

If the person with the obligation to declare gives an unreasonable explanation about the origin of assets and income in the year increasing by 1 billion VND or more, the asset and income control agency will conduct verification.

The draft law also added a provision that "declaring and explaining the origin of assets and additional income is one of the criteria to evaluate and classify the level of task completion of cadres, party members, civil servants and public employees".

Reduce unnecessary administrative procedures in declaration control

Examining the draft law, Chairman of the Law and Justice Committee Hoang Thanh Tung said that the draft law had been carefully and seriously prepared by the Government, in accordance with regulations on submitting drafts according to shortened procedures.

The majority of opinions in the review body also agreed with the scope of amendments and supplements to the draft law. These include increasing the value of assets and income that must be declared and increasing the fluctuation of assets and income in the year that must be additionally declared.

According to the inspection agency, this regulation is consistent with the socio-economic situation, accurately reflects current price and income fluctuations, and ensures centralized management and control of declaration of assets and income of large value.

The regulation also reduces unnecessary administrative procedures for controlling the declaration of assets and small-value income, thereby improving the effectiveness of corruption prevention.

However, there are also opinions that the monetary quantification levels should not be rigidly regulated in the law. Instead, the Government should be assigned to specifically regulate the monetary quantification levels in sub-law documents so that they can be flexibly adjusted in each period, in accordance with the socio-economic situation.
