Proposal to split the Defense and Security Industry Fund into two independent funds

On the morning of October 31, continuing the program of the 10th session, the National Assembly listened to reports on 4 projects: Law amending and supplementing a number of articles of the Law on National Defense Industry, Security and Industrial Mobilization; Law on Cyber ​​Security; Law on Protection of State Secrets (amended); Law amending and supplementing a number of articles of 10 laws related to security and order.

Presenting the report, Politburo member, General Luong Tam Quang, Minister of Public Security, said that the draft Law amending and supplementing a number of articles of the Law on National Defense and Security Industry and Industrial Mobilization stipulates separating the National Defense and Security Industry Fund into two independent funds, including the Security Industry Development Investment Fund and the National Defense Industry Fund; assigning the Ministry of Public Security to manage the Security Industry Development Investment Fund, decentralizing the management of the National Defense Industry Fund from the Government to the Ministry of National Defense .

The amended and supplemented regulations of the Law on Cyber ​​Security focus on the following issues: Supplementing regulations on ensuring data security; supplementing regulations on responsibility for identifying IP addresses and providing them to specialized forces for protecting cyber security; supplementing regulations on funding for protecting cyber security of agencies, organizations, state-owned enterprises, and political organizations; supplementing regulations on encouraging the use of Vietnamese security industry products and services; supplementing regulations on granting cyber security certificates.

The draft Law on Protection of State Secrets (amended) has a number of new points: Expanding and allowing the drafting and storage of state secrets on computer networks as "independent LANs" established within the headquarters of agencies and organizations, without having to encrypt with cryptographic codes to thoroughly remove obstacles in the Law on Protection of State Secrets 2018 and meet the requirements of national digital transformation; adding regulations prohibiting the use of artificial intelligence systems to violate state secrets; adding authority and responsibility in state secret protection activities for commune-level authorities and a number of central agencies organized according to the regional model; adding and perfecting regulations on handling documents containing state secret content in the electronic environment...

The draft Law amends and supplements a number of contents of 10 laws related to security and order that are affected by the results of the organizational restructuring. In addition, the draft Law amends and supplements a number of other contents to meet urgent practical requirements, in line with the policy of breakthroughs in science and technology development, innovation, national digital transformation, decentralization, delegation of power, reduction of administrative procedures and consistency with the legal system.

Presenting the review report, Chairman of the National Assembly's Committee on National Defense, Security and Foreign Affairs Le Tan Toi said that the Committee on National Defense, Security and Foreign Affairs basically agreed with the regulations on the Security Industry Development Investment Fund, the National Security Industry Complex, the Security Industry Development Management Council, with specific and outstanding mechanisms and policies to create an environment for security industry development, meeting the urgent requirements of the practical situation.

The Committee on National Defense, Security and Foreign Affairs agreed on the necessity of promulgating the Law mainly on the basis of consolidating the contents of the 2018 Law on Cyber ​​Security and the 2015 Law on Cyber ​​Security; promptly institutionalizing the Party's guidelines and viewpoints; overcoming overlaps, contradictions, and unclear distinctions of authority and functions between the current Law on Cyber ​​Security and the Law on Cyber ​​Security; meeting practical requirements in the context of extensive digital transformation and complicated developments of cyber attacks and cross-border cybercrime.
