The Ministry of Education and Training is drafting a Law on Teachers, which includes many policies on salaries and benefits for teachers. One of the proposals receiving attention is the extension of working time for teachers who have reached retirement age.
Article 50 stipulates the regulations on extending working hours for teachers:
Teachers holding the titles of professor, associate professor, and doctoral degree who are currently working at educational institutions may extend their working time beyond retirement age to continue teaching and conducting scientific research if the educational institution has a need and approves, and the teacher is in good health and volunteers.
The extended period of time stipulated in Clause 1 of this Article for teachers in public educational institutions shall be implemented as follows:
Not more than 5 years for educators with a doctoral degree;
Not more than 7 years for educators holding the title of associate professor;
Not more than 10 years for educators holding the title of professor.
The duration of the term as stipulated in Clause 1 of this Article for teachers in private and non-profit educational institutions shall be determined by agreement between the teacher and the educational institution.
During the extended working period stipulated in Clause 2 of this Article, teachers in public educational institutions shall only perform professional duties, shall not hold leadership or management positions, and shall not retain leadership position allowances; teachers in private and non-private educational institutions may hold management positions if they meet the requirements of the educational institution.
The decision to extend a teacher's working time must be sent to the relevant organization or individual at least three months before their retirement date.
The government will specify in detail the procedures and processes for considering extensions of working hours; and policies for teachers during extended working hours.
The draft Law on Teachers comprises 9 chapters and 71 articles, closely adhering to the 5 policies approved by the Government in Resolution No. 95/NQ-CP of 2023. The purpose of developing the Law on Teachers is to institutionalize the Party and State's guidelines, policies, and principles regarding teachers, especially the viewpoint that "educational development is a top national priority," and that teachers "play a decisive role in ensuring the quality of education"; to focus on developing a sufficient and high-quality teaching staff; to build a strong teaching force, create motivation for teachers and students, and honor teachers; and to contribute to the improvement of the legal system on education.
According to the plan, the draft Law on Teachers will be submitted to the National Assembly for initial consideration and comments at the Eighth Session (October 2024) and considered and passed at the Ninth Session (May 2025).
