The National Assembly delegation of Binh Thuan province discussed two draft laws and the Government's report.

On the afternoon of November 10th, continuing the program of the 6th session of the 15th National Assembly, the delegation of National Assembly deputies from Binh Thuan province held discussions in Group 15 on two draft laws and government reports, including: the draft Law on Archives (amended); the draft Law on the Capital City (amended); and government reports on the preliminary results of the pilot implementation of the urban government model in Hanoi and Da Nang, and the results of three years of implementing urban government in Ho Chi Minh City.

The majority of delegates in Group 15 agreed on the necessity of drafting the Law on Archives (amended); the Law on the Capital City (amended); and the Government's reports on the preliminary results of the pilot implementation of the urban government model in Hanoi and Da Nang, and the results of three years of implementing urban government in Ho Chi Minh City. Delegate Nguyen Huu Thong commented: After studying the draft Law on Archives (amended), he agreed on the necessity of comprehensively amending the 2011 Law on Archives to overcome the shortcomings and limitations in current archival work, enhance the effectiveness and efficiency of state management of archives; and at the same time, promote the application of information technology and digital transformation in archival activities, meeting the requirements of modernizing the administration and international integration.

Regarding the authority to manage archival documents and archival document databases (Article 9), Clause 3 of Article 9 stipulates: The Ministry of National Defense, the Ministry of Public Security , and the Ministry of Foreign Affairs shall directly manage and archive documents generated during their operations, reserve archival documents, archival documents of special value, and the archival document databases of the defense, public security, and foreign affairs sectors, including documents of the Party organizations of these sectors .” Delegates expressed concern about this issue, as it contradicts Article 3 of the draft on the principles of archival operations and Article 7 on the composition of the Vietnamese National Archives.

Regarding the destruction of obsolete documents (Article 15), it is proposed to remove point d, clause 2, Article 15: " Severely damaged archival documents that are beyond recovery ," because the provision is too general and not specific enough, allowing agencies and organizations to use it as a basis for destruction, risking the permanent loss of valuable documents. It is suggested that the responsibility be added: " The Minister of Home Affairs shall provide detailed regulations on the authority, process, and procedures for destroying obsolete documents at agencies, organizations, and historical archives ." Currently, there is still a problem of unauthorized destruction of obsolete documents; the process of organizing document destruction by agencies, organizations, and individuals still has shortcomings and lacks uniformity.

Commenting on the draft Law on the Capital City (amended), Comrade Duong Van An - Member of the Central Committee of the Party, Secretary of the Provincial Party Committee, Head of the National Assembly Delegation of Binh Thuan Province - Head of Discussion Group 15, commented on the draft Law on the Capital City: Regarding Clause 1, Article 3: ...The sudden growth in customer base and revenue creating great value for customers is actually a startup and innovation project, but it is too large and too high-expectations. According to the draft Law on the Capital City, it will receive preferential policies, but in reality, these are startup and innovation projects that are encouraged rather than evaluated based on effectiveness. In reality, startup and innovation projects have not truly created a sudden surge in revenue or great value for society. It is already very good if startup and innovation projects create new production methods, new fields, new production methods, create new ways of producing goods and consumption, and solve the economic problems of households and small communities. Therefore, there is no need to set such high requirements as in the law. Therefore, laws should encourage society, and making them too difficult will not encourage society to access them…
