Speaking at the national scientific conference "Improving the structure of Vietnam's legal system to meet the requirements of national development in the new era" held on the morning of November 1, comrade Phan Dinh Trac, Politburo member, Party Central Committee Secretary, Head of the Central Internal Affairs Commission, summarized the major viewpoints and orientations presented at the conference.

Accordingly, many opinions agree that it is necessary to identify four important contents in perfecting the structure of the legal system: That is, it is necessary to shift from management legal thinking to constructive legal thinking; focus on reviewing, systematizing, cutting down intermediate levels, eliminating overlapping and conflicting regulations, moving towards a streamlined, unified, transparent and easy-to-implement legal system; comprehensively innovating the law-making process in a scientific and transparent direction, preventing group interests and local interests in policy-making; strongly innovating law enforcement, closely linking law-making and law enforcement, aiming to establish a complete legal life cycle from legislation, executive, judiciary to supervision, feedback and amendments.

In order to perfect the legal system structure to meet the requirements of the country's new era, the Head of the Central Internal Affairs Committee emphasized a number of orientations in the coming time, first of all, building a legal system structure that must ensure full coverage, balance, and reasonable harmony between fields.

The scope of regulation of the legal system needs to be determined in accordance with the Party's breakthrough and strategic decisions. Along with that, it is necessary to increase the promulgation of legal documents, especially legal documents, to more clearly demonstrate the role of creating development of the Socialist Republic of Vietnam in the new era.

The workshop also pointed out that it is necessary to promote the formation of new legal sectors and fields, in addition to existing legal sectors and fields, to meet the requirements of creating and leading the law in the face of new developments in the fields of science, technology and other new fields of socio-economic life, especially those legal sectors and fields associated with the process of digital transformation, green transformation, data economy, circular economy, artificial intelligence and other technologies of the fourth industrial revolution; rationally apply the thinking of classifying and regulating the behavior of public authorities (i.e. public law) and the law regulating the relationship between individuals and private organizations with equal legal status (i.e. private law) when designing legal norms in specific legal fields, thereby allowing the law to partly awaken all potentials and mobilize all resources for national development in the new era.

It is necessary to study and perfect the structure of the legal system in the direction of taking the Constitution and a number of core laws such as the Civil Code, the Penal Code, the Law on Handling of Administrative Violations, the Civil Procedure Code, the Administrative Procedure Law... as the center. Other legal documents must ensure consistency, synchronization and close connection with these legal documents.

Continue to study the reduction of the hierarchy of the legal document system, narrow down the types of legal documents that a competent authority can issue in the direction that each authority only prescribes one form of legal document; Minimize the number of guiding documents regulating documents with higher legal effect. Pay attention to perfecting legislative techniques and modernizing infrastructure, applying advanced technologies in law-making work; conduct a general review of legal documents to handle overlapping, contradictory and inadequacies of the current legal system.

Comrade Phan Dinh Trac requested the Ministry of Justice, the National Assembly's Committee on Law and Justice and relevant agencies to continue to research, refine and absorb the contents of the reports in the discussions and comments at the workshop to serve the research, construction and better completion of the project.

Speaking at the workshop, Vice Chairman of the National Assembly Nguyen Khac Dinh highly appreciated the contributions of the delegates, especially the guiding speech of the Head of the Central Internal Affairs Committee Phan Dinh Trac, and emphasized that the results of the project to perfect the structure of the legal system are the blueprint, the guiding theoretical ideology that paves the way for practice to build a master plan for the construction and completion of the legal system with a long-term vision, both managing, leading, promoting and creating for the country's development in the new era.

On the basis of that master plan and from the requirements of national development, contributing to the completion of the legislative orientation project for the 15th and 16th National Assembly terms for the period 2026-2031, determining the list of laws that the National Assembly must consider, pass, and then amend and supplement during the entire term.
