Are mobilized teachers entitled to preferential teaching allowances?

In the 2024-2025 school year, teachers were drafted to the Department of Education and Training. When drafted, teachers did not return to school to teach. May I ask, will that teacher receive preferential teaching allowance? Tran Van Khoa (vankhoa***@gmail.com)

The preferential allowance regime for teachers is being implemented according to the provisions of Decision No. 244/2005/QD-TTg dated October 6, 2005 of the Prime Minister , and guidance in Joint Circular No. 01/2006/TT-BGDT-BNV-BTC dated January 23, 2006.

According to the guidance in this Circular, the beneficiaries of preferential allowances are teachers (including those on probation or contract) on the payroll, directly teaching in public educational institutions in the national education system and schools, centers, and academies under State agencies, the Party, and socio -political organizations that are funded by the State for their operations (including revenue from the State budget and other revenue sources as prescribed by law).

Teachers (including those on probation or contract) on the payroll of public educational institutions are tasked with leading teams and instructing practice at workshops, stations, camps, and laboratories.

Point b, Clause 2 of Joint Circular No. 01/2006/TT-BGDT-BNV-BTC provides guidance that the subjects specified in Clause 1 of this section are not entitled to preferential allowances during the following periods: Time spent on business trips, working, studying abroad receiving 40% of salary as prescribed in Clause 4, Article 8 of Decree No. 204/2004/ND-CP;

Time spent on business trips or studying in the country without teaching continuously for more than 3 months; Time spent on unpaid personal leave continuously for 1 month or more; Time spent on sick leave or maternity leave exceeding the time limit prescribed by the current Social Insurance Regulations; Time spent suspended from teaching.

Based on the above instructions, the subjects of application are teachers who are directly teaching in public educational institutions. For teachers who are drafted to work at the Department of Education and Training as in your letter but do not directly teach at school, they are not eligible for preferential allowances according to their profession during the draft period.
