Presenting the report, Minister of Science and Technology Huynh Thanh Dat stated that the amendment and supplementation of several articles of the Law on Standards and Technical Regulations aims to promote deep international integration and fully implement international commitments on transparency requirements; promote the socialization of activities in developing, disseminating, and applying standards; enhance the effectiveness of conformity assessment activities; improve regulations on principles, subjects, basis, order, and procedures for developing, appraising, and publishing Vietnamese standards, issuing Vietnamese regulations, and local regulations; and improve the effectiveness of developing and managing basic standards in a more rigorous manner...

The amendments and additions focus on six groups of content within the policies.

Reviewing the draft law, Le Quang Huy, Chairman of the National Assembly's Committee on Science, Technology and Environment, stated that the Standing Committee basically agrees with amending regulations on conformity assessment activities to meet the requirements of transparency in the implementation of FTA agreements.

However, the Bill needs further study and additions to regulations on the operating conditions of conformity assessment organizations to ensure the competitiveness, objectivity, and effectiveness of this activity, especially the certification of conformity to standards and regulations...

The Chairman of the National Assembly's Committee on Science, Technology and Environment also suggested comparing the legal system with laws recently passed by the National Assembly or draft laws currently under consideration to ensure consistency; and continuing to review and compare it with relevant international treaties to which Vietnam is a signatory to ensure compatibility.

Chairman Le Quang Huy also stated that the Standing Committee of the Committee on Science, Technology and Environment requested the drafting agency to review and provide specific guidance on the development, appraisal, and promulgation of local standards in accordance with reality so that they can be implemented in localities; clearly define the time and procedures for ministries and sectors to provide feedback when localities submit proposals requesting the development of standards, limiting the situation of procrastination that affects the socio-economic development of localities.

During the discussion on the draft law, focusing on local technical standards, Nguyen Thanh Hai, Head of the Delegation Affairs Committee of the National Assembly Standing Committee, stated that the issuance of local technical standards faces many difficulties related to qualifications, capacity, and necessity, and therefore requires further assessment of this issue.

Ms. Nguyen Thanh Hai stated that currently only Hanoi has issued local technical standards (Technical standards on planning and architecture in the districts of Ba Dinh, Hoan Kiem, Dong Da, and Hai Ba Trung), while other provinces and cities have not yet issued them; and the 66 other local standards that have been issued relate to products and goods. "Perhaps we should only regulate the basic technical standards of the locality," Ms. Nguyen Thanh Hai said.

According to Vu Hong Thanh, Chairman of the National Assembly's Economic Committee, after 17 years since its enactment, the Law on Standards and Technical Regulations needs to be studied and reviewed for comprehensive amendment to ensure it is consistent with the scale of the economy, the actual situation, the current legal system, and deep integration and participation in many new generation free trade agreements (FTAs).

At the same time, the Chairman of the Economic Committee also reflected that, through monitoring, businesses have reported that some technical standards still have inconsistent regulations and unclear interpretations, leading to difficulties in implementation. For example, standards on fire safety for construction projects, or standards on conditions and investment in trade. In addition, businesses also reported that the process of issuing standards and regulations is "abrupt, too fast, too shocking" without a clear implementation roadmap. "Such issues increase compliance costs for businesses, affecting the competitiveness of their goods. This is something that needs to be amended to create regulations and avoid these inadequacies," Chairman Vu Hong Thanh stated.

During the discussion, the Standing Committee of the National Assembly also suggested that further research is needed on the responsibilities for developing, appraising, publishing, notifying, and applying national standards; applying simplified procedures and processes for developing and issuing national technical standards; developing and applying basic standards for state agencies and enterprises; developing, appraising, and issuing national regulations and local technical regulations, etc.
