Many violations discovered at Ly Tu Trong College, Ho Chi Minh City

The Ho Chi Minh City Department of Education and Training concluded that Ly Tu Trong College in Ho Chi Minh City temporarily collected tuition fees of more than 158 billion VND in violation of regulations, and that enrollment and financial management showed signs of violating the law.

The Department of Education and Training has issued a document announcing the results of the inspection of the implementation of functions and tasks of Ly Tu Trong College, Ho Chi Minh City, with many notable contents.

Temporary collection of tuition fees in violation of regulations

According to the Department, from the 2020-2021 school year to the 2024-2025 school year, Ly Tu Trong College has temporarily collected tuition fees from 15,943 students, with a total amount of more than 158 billion VND; has refunded 13,921 students, with a total amount of 137.6 billion VND. Currently, it has not refunded 2,022 students, with a total amount of 20.4 billion VND.

However, this temporary tuition collection only applies to "non-public educational institutions; vocational education and higher education institutions belonging to state-owned enterprises and economic organizations".

Therefore, Ly Tu Trong College's application of this regulation to temporarily collect tuition fees from students who are eligible for tuition exemption or reduction for the 2020-2021 school year (applied according to Decree No. 86/2015); then making and withdrawing the budget estimate for tuition exemption or reduction compensation to refund the temporarily collected amount to students at the end of the school year is not in accordance with regulations.

The school has not promptly and thoroughly carried out the refund of tuition exemptions and reductions, resulting in a large amount of tuition exemptions and reductions remaining for students who are eligible for tuition exemptions and reductions.

The amount of provisional tuition fees collected from students at the beginning of the school year is recorded by the school as tuition fees collected together with tuition fees collected from other subjects not subject to the policy. This amount and other revenues are deposited by the school into a deposit account opened at a commercial bank for general monitoring. Ly Tu Trong College has not yet submitted all tuition fees to the State Treasury for management and use according to regulations.

For the above reason, bank interest arising from provisional collection (tuition fees) cannot be separated from other revenue receipts.

The school shall record the tuition fee collection account for the amount of tuition fee provisionally collected from students who are eligible for tuition fee exemption or reduction and withdraw the estimated budget for tuition fee exemption or reduction compensation to the unit's deposit account opened at the State Treasury to refund to students at the end of the school year.

However, with the two amounts mentioned above, Ly Tu Trong College showed the figures in the accounting books but did not clearly state the provisional receipts and payables in the Explanation of the final settlement report and the annual financial report, which is not in accordance with the regulations of the Ministry of Finance .

College admission is not in accordance with regulations

The decision to establish a class (open a class) was issued on November 1, 2022. However, many admission decisions for the 2022 college-level transfer class (22C2B) in Automotive Technology were issued after the decision to establish a class.

Some other notable contents pointed out by the Department of Education and Training such as Ly Tu Trong College signing a guest teaching contract with the school's permanent teachers is not in accordance with the provisions of Article 71 of the 2019 Education Law.

The school assigned teachers to teach beyond the prescribed teaching hours, of which in the 2022-2023 school year, 117 lecturers taught beyond the prescribed teaching hours of 9 faculties with a total of 40,773 hours.

In the 2023-2024 school year, 76 lecturers taught more than the prescribed teaching hours of 11 faculties, with a total of 16,884 hours.

In particular, there are cases where teachers are assigned to teach a large volume of lessons and large class sizes, with an average of 350 students/class.

Coordinate with the police on signs of violations

After a surprise inspection of the implementation of functions and tasks of Ly Tu Trong College in Ho Chi Minh City, the inspection team discovered many administrative violations in the field of vocational education or signs of violations of the law in public financial management, management and use of public assets, accounting, and bidding activities.

In order to have a basis to submit to the City People's Committee for consideration and decision on handling administrative violations in the field of vocational education or signs of law violations by Ly Tu Trong College, the Department of Education and Training coordinates with the City Police and related units to complete the contents of consultation with the City People's Committee.
