The Ministry of National Defense has just issued Consolidated Document No. 92/VBHN-BQP deciding on the implementation of the regime for soldiers who participated in the resistance war against the US to save the country with less than 20 years of service in the army and have been demobilized and returned to their localities.

Accordingly, this Decision regulates the implementation of the regime for soldiers participating in the resistance war against the US to save the country, enlisted from April 30, 1975 or earlier, with less than 20 years of service in the army, demobilized, discharged and returned to their localities, currently not eligible for pension, disability benefits or monthly sick leave benefits.
Article 2 states : Soldiers who participated in the resistance war against the US to save the country, enlisted from April 30, 1975 or earlier, with 15 years to less than 20 years of service in the army, demobilized, discharged and returned to their localities (including those who continued to work and then quit), are entitled to a monthly allowance according to the actual number of years of service in the army, with 15 years of service receiving a subsidy of 600,000 VND/person/month; then for each additional year (12 months), an additional 5% is calculated on the starting subsidy level.
When the Government adjusts salaries and allowances, the benefits of the above subjects will be adjusted accordingly.
A person who receives a monthly allowance and dies will no longer receive it from the following month; relatives of the deceased will receive a one-time allowance equal to 3 months of the deceased's current allowance.
Article 3 states: Soldiers who participated in the resistance war against the US to save the country, enlisted from April 30, 1975 or earlier, with less than 15 years of service in the army, demobilized, discharged and returned to their localities (including those who continued to work and then quit), are entitled to a one-time allowance calculated based on the actual number of years of service in the army, with the following benefits:
With 2 years of actual work in the army or less, the allowance is 2,000,000 VND; From the 3rd year onwards, each year is calculated to receive an allowance of 600,000 VND.
When calculating the time to receive a one-time subsidy, if there are odd months, 6 months or more will be counted as a full year, less than 6 months will be counted as half (1/2) year.
Article 4 states : Subjects specified in Clause 1, Article 2 who passed away before January 1, 2009, subjects specified in Article 3 who passed away before the effective date of this Decision (including those who passed away while in the army), one of the following persons: Wife or husband; biological father, biological mother; biological child, adopted child or legal guardian of the deceased shall be entitled to a one-time subsidy of 3,000,000 VND.
The funding source for implementing the regimes prescribed in this Decision is guaranteed by the central budget.
The confirmation and approval of beneficiaries of the regime stated in this Decision must be public, strict, accurate and convenient.
Those who falsify or forge documents to enjoy benefits, depending on the nature and severity of the violation, will be subject to disciplinary action or criminal prosecution and must compensate for damages (if any) according to the provisions of law.
This Decision takes effect from January 1, 2009.
Ministers, Heads of ministerial-level agencies, Government agencies, Chairmen of People's Committees of provinces and centrally run cities are responsible for implementing this Decision.
