On the afternoon of November 26th, as part of the agenda for the 8th session, the National Assembly proceeded to vote on and pass the Law on Urban and Rural Planning with a high percentage of votes in favor.

After hearing the report on the acceptance, explanation, and revision of the draft law presented by Vu Hong Thanh, member of the Standing Committee of the National Assembly and Chairman of the Economic Committee, the National Assembly proceeded to vote on and pass this law.

The results of the electronic vote showed that 455 out of 456 National Assembly deputies participating in the vote approved, representing 94.99% of the total number of National Assembly deputies.

The Law comprises 5 Chapters and 59 Articles, regulating the urban and rural planning system; the preparation, appraisal, approval, review, adjustment, and management of planning; and state management of planning. The Law stipulates that urban and rural plans must be prepared, appraised, and approved ensuring consistency and compatibility between different types and levels of planning according to the following principles: General plans may be prepared simultaneously; if general plans are approved by different authorities, the general plan with the higher authority must be approved first; if general plans are approved by the same authority, the general plan prepared and appraised first will be approved first; Sub-area plans specify the general plan regarding: development objectives; economic and technical indicators; development orientation, spatial organization and functional zoning; development orientation of technical infrastructure systems, social infrastructure systems, and underground space (if any). The content, requirements, and principles for ensuring specific implementation must be clearly defined and stipulated in the plan.

Underground space planning and specialized technical infrastructure planning for a centrally-governed city must be synchronized; they must specify development goals, orientations for underground space planning and the framework of technical infrastructure systems; and they must be consistent and synchronized with the spatial development and landscape architecture orientations in the city's master plan. The content, requirements, and principles for ensuring these specificities must be clearly defined and stipulated in the plan.

According to this Law, urban areas are classified into six categories: special, category I, category II, category III, category IV, and category V, as stipulated in the law on urban classification. The determination of standards and classification of urban and rural administrative units is carried out according to the law on the organization of local government. Based on the socio-economic development situation of each period, the Government submits to the Standing Committee of the National Assembly specific regulations on urban classification to ensure the development trends of green, smart, modern, sustainable cities that are adaptable to climate change.

Regarding funding for urban and rural planning activities, the Law stipulates that the State shall ensure funding in accordance with the provisions of the law on the state budget. Sources of funding for planning activities include: recurrent expenditure from the state budget; funding from the organization selected as the investor; and other legitimate sources of funding.

Funding for urban and rural planning activities is used for the following tasks: Topographic surveys for planning purposes; Preparation and adjustment, consultation, appraisal, and approval of planning tasks; Management of planning activities; Publication and disclosure of plans; Marking of boundaries according to plans; Preparation of planning review reports; Organizing bidding; Organizing planning idea competitions; Gathering opinions on plans; Building, managing, and operating planning databases; Other work related to urban and rural planning activities.

Regarding the publication of urban and rural planning, the Law clearly stipulates that, no later than 15 days from the date the plan is approved, its contents must be publicly disclosed; for contents classified as state secrets, compliance with the law on the protection of state secrets must be ensured. The content and documents to be published include: Decision approving the planning task (if any); Decision approving the plan; Planning drawings; Planning explanation; and Regulations on management according to the plan.

Regarding the construction of urban and rural planning databases, the Law stipulates that the planning database includes electronic data of planning documents after approval, and a geographic database on planning linked to the standardized national geographic database system. The information system and database are built, managed, and shared uniformly nationwide, serving planning activities.

Urban and rural planning databases must be developed and implemented during the planning process and must be regularly updated; ensuring synchronous connection with the national planning database and the national land database; ensuring support for management; and meeting the requirements for transparency, openness, and access to information for agencies, organizations, and citizens. The Government shall regulate the construction, management, operation, and exploitation of planning databases.

This Law shall take effect from July 1, 2025. For construction plans, urban plans, and individual urban designs that were approved before the effective date of this Law, they shall remain in effect until the expiration date of the plan as stipulated in this Law.
