After 15 days of approval, the content of the planning must be publicly announced.

On the afternoon of November 26, implementing the Program of the 8th Session, the National Assembly voted to pass the Law on Urban and Rural Planning with a high approval rate.

After listening to the report on receiving, explaining and revising the draft Law presented by the member of the National Assembly Standing Committee (NASC), Chairman of the Economic Committee Vu Hong Thanh, the National Assembly voted to pass this Law.

The electronic voting results showed that 455/456 National Assembly deputies participated in the vote in favor, accounting for 94.99% of the total number of National Assembly deputies.

The Law consists of 05 Chapters and 59 Articles, regulating the urban and rural planning system; establishment, appraisal, approval, review, adjustment, organization and management of planning; state management of planning. The Law stipulates that urban and rural planning must be established, appraised, and approved to ensure consistency and conformity between planning types and levels according to the following principles: General plans can be established simultaneously; in case the general plan is approved by a different authority, the general plan with a higher authority must be approved first; in case the general plan is approved by the same authority, the general plan that is established and appraised first must be approved first; Zoning planning specifies the general planning in terms of: development objectives; economic and technical indicators; development orientation, spatial organization and functional zoning; orientation for development of technical infrastructure systems, social infrastructure works and underground space (if any). The content, requirements and principles of ensuring specificity must be clearly defined and specified in the planning.

Underground space planning and specialized technical infrastructure planning for a centrally-run city must be synchronized with each other; specify development goals, planning orientations for underground space and the framework technical infrastructure system; be unified and synchronized with the orientations for space development and landscape architecture in the general planning of the centrally-run city. The content, requirements and principles to ensure concretization must be clearly defined and stipulated in the planning.

According to the provisions of this Law, urban areas are classified into 6 types including special type, type I, type II, type III, type IV and type V according to the provisions of the law on urban classification. The determination of standards and classification of urban administrative units and rural administrative units is implemented according to the provisions of the law on local government organization. Based on the socio-economic development situation of each period, the Government shall submit to the Standing Committee of the National Assembly specific regulations on urban classification to ensure the development trends of green, smart, modern, sustainable and climate change-adaptive urban areas.

Regarding funding for urban and rural planning activities, the Law stipulates that the State shall ensure funding according to the provisions of the law on the State budget. Funding sources for planning activities include: Regular expenditures from the State budget; Funding of organizations selected as investors; Other legal funding sources.

Funds for urban and rural planning activities are used for the following tasks: Topographic survey for planning; Establishment and adjustment, consultation, appraisal, approval of planning tasks; Management of planning work; Announcement and publicization of planning; Setting up landmarks according to planning; Preparation of planning review reports; organization of bidding; organization of planning idea contests; consultation on planning; Construction, management, and operation of planning databases; Other tasks related to urban and rural planning activities.

Regarding the announcement of urban and rural planning, the Law clearly stipulates that no later than 15 days from the date of approval of the planning, the content of the planning must be publicly announced; for contents that are state secrets, it is necessary to ensure compliance with the provisions of law on the protection of state secrets. The contents and documents of the planning announcement include: Decision approving the planning task (if any); Decision approving the planning; Planning drawings; Planning explanation; Regulations on management according to the planning.

Regarding the construction of urban and rural planning databases, the Law stipulates that the planning database includes electronic data of planning documents after approval, and the geographic database on planning linked to the standardized national geographic database system. The information system and database are built, managed and shared uniformly nationwide, serving planning activities.

The urban and rural planning database must be developed during the planning process and must be updated regularly; ensuring synchronous connection with the national planning database and the national land database; ensuring management services; meeting the requirements of publicity, transparency, and access to information of agencies, organizations, and people. The Government regulates the development, management, operation, and exploitation of the planning database.

This Law shall come into force from July 1, 2025. Construction planning, urban planning, and separate urban designs approved before the effective date of this Law shall continue to be effective until the end of the planning validity period as prescribed in this Law.
