Ho Chi Minh City Department of Education addresses concerns regarding subsidies for preschool children.

The Ho Chi Minh City Department of Education and Training has recently sent a document to the People's Committees of wards, communes, and special zones responding to some information related to the implementation of Resolution 30 of the Ho Chi Minh City People's Council on policies for the development of preschool children in industrial zones.

With Resolution No. 30 (effective September 1, 2025) stipulating policies for the development of preschool education in areas with industrial zones and a large workforce in Ho Chi Minh City, the Ho Chi Minh City Department of Education and Training believes that some units are encountering difficulties in the implementation process.

This department has compiled and commented on the groups of issues.

Schools only receive support when at least 30% of preschool children are from industrial zone workers.

The Department cited opinions from ward and commune units such as Tan Hai, Phu My, and Tan Thanh. These opinions concerned whether preschool children of workers, teachers, staff, and employees in state agencies and other professions with labor contracts and social insurance contributions are eligible for benefits under Resolution No. 30.

In response to this, the Ho Chi Minh City Department of Education and Training cited provisions in Decree 105, Decree 145, Labor Law No. 45, and Civil Servant Law No. 58, emphasizing the need to define and distinguish between labor contracts and employment contracts.

A labor contract is an agreement between two parties: the employee and the employer, outlining paid employment, wages, working conditions, and the rights and obligations of each party.

A work contract, on the other hand, is a written agreement between a public employee and the head of a public service unit regarding job position, salary, benefits, etc.

Meanwhile, Phu Dinh ward raised concerns about the policy's binding conditions. Specifically, do nurseries, kindergartens, and preschools in areas with a large workforce that receive support have to meet the condition that at least 30% of the children are the offspring of workers or employees working in industrial zones or areas with a large workforce?

The Department argues that, according to Clause 2, Article 81 of Decree No. 145, children are entitled to policies applicable to independent, private, and self-run preschools located in industrial zones, licensed in accordance with regulations, where at least 30% of the children are the offspring of workers and employees in those industrial zones.

If teachers in nursery groups receive support, will teachers in preschools also receive support?

Phu Dinh Ward, being a place with a large workforce, has support for teachers working in nurseries and kindergartens; so, is there support for teachers in preschools and kindergartens?

According to the Ho Chi Minh City Department of Education and Training, the consideration for this support is also based on Decree No. 145 and Resolution No. 30, which provide detailed regulations and guidance on some articles of the Labor Code regarding labor conditions and relations.

Regarding the concerns of Binh Duong and Tan Thanh wards, are children of workers and laborers working in companies and production and business establishments outside industrial zones, and children of private and non-governmental kindergartens in industrial clusters, eligible for the early childhood education development policy under Resolution No. 30?

The Department cited the articles, clauses, and beneficiaries of the policy; the regulations on the management of industrial parks and economic zones, and stated that: if the ward or commune is an industrial park and has a large workforce, then all children are entitled to the policy.

Currently, Ho Chi Minh City has more than 1,000 independent preschools, serving 92,000 children of factory workers and employing approximately 6,000 preschool teachers in the private sector.

Following the merger, the Ho Chi Minh City People's Committee increased the allowance for preschool children of workers from 160,000 to 240,000 VND/month, raised the support for teachers in private schools to 1 million VND/month, and expanded the scope of application to include residential areas with a high concentration of workers.

What legal basis determines where there is a high labor supply for preschool children to receive support?

According to the Ho Chi Minh City Department of Education and Training, wards and communes such as Phu Dinh, Tan Hai, Phu My, Binh Gia, and Tan Thanh have provided feedback on the legal basis for determining areas with a high concentration of laborers.

Based on Government Decree No. 145, the department cites areas with a large workforce as defined as industrial zones, with 5,000 or more workers employed in enterprises and participating in social insurance within the industrial zone. Alternatively, it defines communes, wards, and towns with 3,000 or more workers registered as permanent or temporary residents.

Currently, the department has coordinated with the Management Board of Export Processing Zones and Industrial Parks and the Department of Industry and Trade to provide a list of industrial parks and has submitted a report to the Ho Chi Minh City People's Committee on reviewing and identifying areas with a high concentration of workers.
