Amending regulations on documents for people exiting and entering the country through border gates and land border openings
The Ministry of National Defense said that implementing the conclusions of the Politburo and the Secretariat on the policy of rearranging and reorganizing administrative units at all levels, along with studying, amending and supplementing the Constitution, the Law amending and supplementing the Law on Organization of Local Government (expected to abolish district-level administrative units; local governments are only organized into 02 levels including provincial level and below provincial level), the Project to continue organizing local military, provincial Border Guard "sleek, compact, strong" to meet the requirements of tasks in the new situation (dissolving the District Military Command, establishing the Regional Defense Command, a unit equivalent to the Brigade level, directly under the Provincial Military Command and dissolving the Provincial Border Guard Command, establishing the Border Guard Command, a unit equivalent to the Division level, directly under the Provincial Military Command), leading to a number of provisions in the circulars of the Minister of National Defense that are not confidential on border protection and national borders that need to be studied, amended and supplemented to ensure ensure fit
Therefore, the Ministry of National Defense has drafted a Circular amending and supplementing a number of articles of the Circulars of the Minister of National Defense that are not confidential on border defense and national borders.
Amending regulations on border areas
Draft amending and supplementing a number of articles of Circular No. 43/2015/TTBQP dated May 28, 2015 of the Minister of National Defense guiding the implementation of a number of articles of Decree No. 34/2014/ND-CP dated April 29, 2014 of the Government on the Regulations on land border areas of the Socialist Republic of Vietnam
Specifically, amend Article 2 on border areas as follows:
Land border areas specified in Point a, Clause 1, Article 1 of Decree No. .../2025/ND-CP dated ... month ... year 2025 of the Government amending and supplementing a number of articles of the Government's Decrees on border defense and national borders. In case the Standing Committee of the National Assembly decides to adjust the administrative boundaries of communes and wards, the Chairman of the People's Committee of the province where the national border is located shall, based on Point a, Clause 1, Article 1 of Decree No. .../2025/ND-CP, synthesize and report to the Ministry of National Defense to propose the Government to supplement or remove from the list of communes, wards and border areas in the Appendix issued with this Decree.
Documents of people exiting and entering the country through border gates and land border openings
Draft amending and supplementing a number of articles of Circular No. 09/2016/TT-BQP dated February 3, 2016 of the Minister of National Defense detailing and guiding a number of articles of Decree No. 112/2014/ND-CP dated November 21, 2014 of the Government regulating the management of land border gates.
Specifically, amend and supplement points a, b, clause 1 and points b, c, clause 2, Article 8 on documents of people exiting and entering the country through border gates and land border openings prescribed in Article 8 of Decree No. 112/2014/ND-CP as follows:
Vietnamese citizens exiting or entering the country through international border gates or main border gates (bilateral) must have one of the following documents:
- Diplomatic passport; Official passport; Ordinary passport (collectively referred to as passport);
- Border pass; Entry and exit pass; Border entry and exit pass; Repatriation pass; Travel document; Identity card; Citizen identification card (for Vietnamese border residents on the Vietnam - Cambodia border);
- Other documents suitable for exit and entry according to the provisions of Vietnamese law or international treaties to which the Socialist Republic of Vietnam is a member.".
Vietnamese citizens exiting or entering the country through secondary border gates must have one of the following documents:
- Border pass; Entry and exit pass; Border entry and exit pass; Repatriation pass; Travel document; Identity card; Citizen identification card (for Vietnamese border residents on the Vietnam - Cambodia border);
- Other documents suitable for exit and entry according to the provisions of Vietnamese law or international treaties to which the Socialist Republic of Vietnam is a member.".
Foreigners who are citizens of neighboring countries entering or exiting through international border gates or main border gates (bilateral border gates) must have one of the following documents:
- Passport or valid international travel document and visa issued by a competent state agency of Vietnam (except in cases of visa exemption under international treaties to which the Socialist Republic of Vietnam is a member or in cases where Vietnam unilaterally exempts visas for citizens of that country or in accordance with other provisions of Vietnamese law on visa exemption).
- Border pass; Identity card (for residents of Laos and Cambodia border);
- Other exit and entry documents as prescribed by Vietnamese law or international treaties that Vietnam has signed with countries sharing borders.
Citizens of border provinces, border districts, and border residents of neighboring countries entering or exiting through secondary border gates must have one of the following documents:
- Border pass; Border entry and exit pass (for Vietnam - China border); Identity card (for Cambodian border residents)
- Other exit and entry documents as prescribed by Vietnamese law or international treaties that Vietnam has signed with countries sharing borders.
