Pay the price for reckless behavior

The defendants heard the verdict.

All of them come from families with difficult circumstances, making a living by doing many different jobs. However, due to lack of familyeducation , most of them have criminal records, becoming a burden to society. Based on the investigation results, on the evening of April 13, 2024, Sang and Cuong had a conflict and fought with Nguyen Trong (born in 1998, residing in Nui Sam ward) and Hung. Sang and Cuong told Ho Duc Loi's group about the incident while the group was drinking at the restaurant.

Being arrogant and acting without thinking, Sang, Cuong and Tran Van Thai (born in 2006, residing in Vinh Te commune) brought weapons to Trong's house to start a fight. However, when they arrived, they saw Trong's group with many people holding weapons, so all 3... ran back to the drinking place and told Loi. Afraid that if they stayed at the place, Trong's group would beat them up, they all left, took the weapons they were hiding, and "waited" for Trong's group.

In the early morning of April 14, Trong's group, including Hung, Pham Thanh Hung (born in 2003, residing in Vinh Loi district, Bac Lieu province), Nguyen Hoang Phuc (born in 1996), Thai Huynh Vu Hau (born in 1995, residing in Nui Sam ward) and 5 other young men (identity and background unknown) fought with Loi, Sang, and Cuong, causing disorder in the residential area. As a result, Loi suffered 6% injury and was taken to the hospital for stitches, while Sang suffered minor injuries. After receiving the information, the authorities investigated and identified the related subjects. From August 26, 2024 to January 22, 2025, Hung, Trong, Phuc, Thai, Cuong, Sang, Hung, and Hau were prosecuted and detained for investigation.

Just because of petty conflicts in life, the defendants gathered into gangs, fought each other using dangerous weapons to cause injuries, disrupt security and order, and cause outrage among the people. According to the representative of the People's Procuracy holding the right to prosecute at the trial, Cuong and Hung were the masterminds; Hung, Trong, Thai, Sang, Phuc and Hau committed the crimes. At the same time, the defendants Hung and Trong themselves had been convicted, had not had their criminal records cleared, and still reoffended, so the penalties for the defendants must be higher. Hau did not admit to his crimes, in order to evade criminal responsibility, a high penalty must be applied to be sufficient to educate and reform. After considering all relevant circumstances, personal background and role of each defendant, the People's Court of Chau Doc City decided to sentence Trong and Hung each defendant to 3 years in prison; defendant Cuong to 2 years and 9 months in prison; Hung, Sang, Phuc, Hau each defendant to 2.5 years in prison; Thai was sentenced to 1.5 years in prison, both for the crime of "Disturbing public order" under Point b, Clause 2, Article 318 of the Penal Code.

Regarding the case, the defendant Ho Duc Loi has fled the locality, his whereabouts are unknown. The investigation agency has issued a wanted notice 126/QĐTN-ĐTTH, separating him into another criminal case. When Loi is arrested, he will be investigated and handled later. In addition, for subjects whose identities and backgrounds are unknown, the authorities will continue to investigate, verify and clarify, and propose handling later.
