Clearance according to procedure

On August 12, 2019, the Provincial Inspectorate issued 3 conclusions No. 518/KL-TTr, 519/KL-TTr, 520/KL-TTr on compliance with the provisions of the law on land, investment, construction, production and business activities for enterprises operating and leasing land in Phu Thai Port. The inspection conclusions pointed out many violations, including requiring Mr. Dang Duc Chuc, owner of the Ship Repair and Construction Facility, to be responsible for handing over 12,404 m2 of land to The Anh Production and Trading Company Limited (The Anh Company) according to Decision No. 4778/QD-UBND dated December 16, 2008 of the Chairman of the People's Committee of Hai Duong province. For 3,070 m2 of public land managed by the People's Committee of Phu Thai town, after inspection and verification, if the investor wishes to continue using it, it is necessary to fully carry out the procedures and order according to the provisions of the law on land to be able to lease the land according to regulations.

After many years of failing to hand over land to The Anh Company, on April 18, the People's Committee of Phu Thai town (Kim Thanh, Hai Duong) organized a team to clear violations. Previously, the People's Committee of Kim Thanh district and the People's Committee of Phu Thai town issued a plan to implement the conclusions of the Provincial Inspectorate, and sent three invitations to Mr. Dang Hung Thang, Director of Thang Loi Mechanical Company Limited - the person authorized by Mr. Dang Duc Chuc to come to the headquarters of the People's Committee of Phu Thai town to work to implement the inspection conclusions. However, all three times, Mr. Thang did not show up according to the invitation. The People's Committee of Phu Thai town established a propaganda and mobilization team to visit Mr. Thang's house, but Mr. Thang's family reported that he was not at home.

Before organizing the clearance of violations, on April 17, the People's Committee of Phu Thai town went to the gate of Phu Thai Port to send a notice of the plan to clear the violations, but Mr. Thang did not receive the notice. On April 18, the People's Committee of Phu Thai town organized the clearance of violations and determined the boundary of the above land plot. The local government and the police, military , land administration, regulations, and mass organizations carried out propaganda and mobilization to clear the violations of the above land plot. The functional forces moved all vehicles and equipment out of the violation area. The clearance and boundary determination were completed, ensuring safety and in accordance with the provisions of law.

Resolve the matter once and for all

On May 11, Hai Duong Newspaper reporters were present at Phu Thai Port and saw that the boundary markers between Mr. Dang Duc Chuc's Ship Repair and Construction Facility and The Anh Company, previously determined by the People's Committee of Phu Thai Town, were still maintained. All activities in the port were basically operating normally. However, a large amount of coal was still gathered on the land area of ​​The Anh Company. Mr. Chuc's Ship Repair and Construction Facility still existed on this land plot. Two internal roads running around the port, at the junction between Mr. Chuc's facility and The Anh Company, had two piles of iron across them, obstructing the movement of vehicles in the port. Due to the lack of a clean site, up to this point, The Anh Company has not been able to carry out the next tasks.

To resolve the above case, the People's Committee of Phu Thai town needs to request Mr. Dang Hung Thang, Director of Thang Loi Mechanical Company Limited - the person authorized by Mr. Dang Duc Chuc to carry out activities at Phu Thai Port, to clear all assets on 12,404 m2 of land rented by The Anh Company according to Decision No. 4778/QD-UBND dated December 16, 2008 of the Chairman of Hai Duong Provincial People's Committee. Mr. Thang needs to coordinate with the provincial authorities, Kim Thanh District People's Committee, Phu Thai Town People's Committee and relevant agencies to carry out procedures in the correct name of the project investor according to regulations. Currently, Phu Thai Port is still owned by Mr. Dang Duc Chuc, Mr. Thang's father, Mr. Thang only accepts authorization to carry out. According to regulations, the authorization letter is only valid for 1 year. Currently, Mr. Chuc has passed away.

The Anh Company needs to proactively coordinate with the competent authorities of Hai Duong province, Kim Thanh district People's Committee, Vietnam Maritime Administration and Inland Waterways ( Ministry of Construction ) to fully implement the regulations on project establishment procedures and construction investment. Review the land use needs of the project; in case the project's investment objectives of construction and wharf business do not meet the conditions for implementation according to regulations, proactively request the competent authority of the province to adjust the content and objectives of the investment project according to regulations.

Enterprises operating and leasing land in Phu Thai Port, including Mr. Dang Duc Chuc's Ship Repair and Construction Facility, The Anh Company and Hong Ha Cooperative, need to agree to remove all obstacles on the internal roads in the port. The two entrances and exits of Phu Thai Port must not be used to obstruct the operations of enterprises doing business inside. The People's Committee of Phu Thai town has a plan to protect the land area that has just been cleared before the competent authority hands over the site to The Anh Company to implement the project.

Because the land has not been allocated in the field, from 2008 to now, The Anh Company has not had to pay land use fees on an area of ​​12,404 m2. The Tax Department of Region V (formerly the Tax Department of Hai Duong Province) needs to coordinate to determine the time when Mr. Dang Duc Chuc's Ship Repair and Construction Facility used the land of The Anh Company and the area exceeding the decision of the People's Committee of Kim Thanh District to allocate for business purposes, thereby collecting land use fees.

The Department of Agriculture and Environment coordinated with the People's Committee of Kim Thanh district to advise the Provincial People's Committee to review Decision No. 162/QD-UBND dated January 13, 2004 allowing Mr. Dang Duc Chuc to establish a site for material transit and boat repair at the outer bank of the Kinh Mon river right dike under the correct name of the investor; the location and land area of ​​the project are rented according to the provisions of the law on land and dikes.
