From August 15, 2023, the police issue and manage vehicle license plates based on the vehicle owner's identification code. So how is a vehicle license plate with an identification code determined if it's not registered in the owner's name? Will it be identified by the previous owner or the new owner?
How are vehicles that are not registered in the owner's name identified?
According to Article 39 of Circular 24/2023/TT-BCA, vehicles registered with 5-digit license plates before August 15, 2023, that have not yet undergone the revocation procedure, will have those license plates identified as the vehicle owner's license plates. Vehicles registered with 5-digit license plates that have undergone the revocation procedure before August 15, 2023, will have those license plates transferred to the license plate inventory for issuance according to regulations.
Meanwhile, vehicles already registered with 3-digit or 4-digit license plates will not be identified, and the owner can continue to use them for traffic.
Therefore, the identification of a vehicle that is not registered in the owner's name will be determined as follows:
- For vehicles registered with a 5-digit license plate but not registered in the owner's name: That license plate is automatically assumed to be the identification plate of the person whose name is on the vehicle registration certificate.
Simply put, if a vehicle is registered with a 5-digit license plate but the owner is not the registered owner, that license plate will be managed according to the identification code of the previous owner, not the current owner (the new owner).
- Vehicles that are not registered in the owner's name but have 3-digit or 4-digit license plates: Those license plates are not considered identifiable.
The vehicle owner is allowed to continue using it for traffic. However, after the transfer of ownership, both the old and new owners must strictly follow the regulations regarding the transfer of vehicle ownership to avoid penalties for driving a vehicle without proper registration.

Procedures for transferring vehicle ownership when the vehicle is not registered in the owner's name.
Transferring vehicle ownership to someone who is not the registered owner, starting from August 15, 2023, will be done according to the following steps:
Step 1: The previous owner of the vehicle completes the procedure for revocation of vehicle registration and license plates. The owner fills out the vehicle registration and license plate revocation form on the public service portal; provides the online vehicle registration file code; and submits the required revocation documents.
If the vehicle has had multiple previous owners, the current user can carry out this procedure themselves.
Step 2: The new owner completes the vehicle ownership transfer procedures.
The new owner registers the vehicle online and submits the necessary documents for transferring ownership, including:
- Vehicle registration certificate (if the vehicle has had multiple previous owners, clearly state the buying and selling history and a commitment to taking responsibility for the vehicle's legal origin).
- Vehicle owner's documents.
- Vehicle ownership transfer documents (in cases where the vehicle has had multiple previous owners, if available, submit the vehicle ownership transfer documents from the current owner and the vehicle ownership transfer documents from the last seller).
- Receipt for registration fee payment.
- Certificate of vehicle registration and license plate revocation.
Upon submission of a valid application, the vehicle registration authority will issue a vehicle identification license plate in accordance with regulations.
