According to the Decision, the review and enforcement of discipline against Party organizations and Party members under the authority of the Party Central Committee, the Politburo and the Secretariat shall follow a 3-step process. Specifically as follows:
Preparation steps
The Central Inspection Commission submits to the Politburo and the Secretariat (through the Central Party Office) a case file including: a submission, a report proposing disciplinary action against the violating Party organization and Party members, and related documents.
The Central Party Office copies and sends the case files submitted by the Central Inspection Commission to the Politburo members and Secretariat members, and the case files submitted by the Politburo to the Central Party Executive Committee members according to working regulations.
The Standing Secretariat assigns Politburo members and Secretariat members to listen to representatives of Party organizations and violating Party members present their opinions before holding a conference to consider discipline. If the violating Party member is a Politburo member or a member of the Secretariat, the General Secretary or the Standing Secretariat will listen to the violating Party member present his or her opinion.
Steps to take
In this step, two conferences will be held. The first is the Politburo and Secretariat conference to consider and decide on disciplinary action, with participants including the Politburo or Secretariat; representatives of the Central Inspection Committee, the Central Organization Committee, and the Central Party Office.
If necessary, invite representatives of the Party organization, the violating Party member and representatives of the Party organization managing the Party member.
At this conference, representatives of the Central Inspection Commission presented a report proposing disciplinary action.
Next, the representative of the violating Party organization and the violating Party member presents their opinions, and the Party organization with the violating Party member speaks.
In case of absence, the representative of the Central Party Office leadership will present a review report of the Party organization, Party members who violated the law and opinions of relevant organizations and individuals (if any).
Politburo members or Secretariat members assigned to meet with representatives of Party organizations and Party members who have violated regulations before the disciplinary review meeting shall report on the results of the meeting and discussion.
Then, the conference discusses and votes to decide on disciplinary measures or votes to propose that the Party Central Committee consider and enforce disciplinary measures according to regulations.
In case the Politburo and the Secretariat propose that the Party Central Committee consider and enforce discipline, the Central Inspection Committee shall preside over and coordinate with the Party Central Office to prepare the case file for the Politburo to submit to the Party Central Committee.
In case the Politburo and the Secretariat decide not to take disciplinary action, the Central Party Office shall notify in writing the Central Inspection Commission and relevant Party organizations and Party members.
Second, the Party Central Committee Conference considers and decides on disciplinary action. The members include the Party Central Committee; representatives of the Central Inspection Committee, the Party Central Committee Office, the Central Organizing Committee, and relevant Party committees.
At the conference, the Politburo representative read the report and proposal for disciplinary action.
Next, the representative of the Party organization and the Party member who violated the law presents their opinions (if the violating Party member is a member of the Party Central Committee, the violating Party organization is headed by a member of the Party Central Committee attending the meeting).
After that, the conference will discuss and vote to decide on the form of discipline by secret ballot. In case the Party Central Committee decides not to enforce discipline, it will authorize the Politburo and the Secretariat to notify relevant Party organizations and Party members in writing.
Final step
The Central Inspection Commission presides over and coordinates with the Party Central Office to advise the Party Central Executive Committee, the Politburo, and the Secretariat to issue decisions on disciplinary action or notices of non-disciplinary action.
The Politburo or the Secretariat shall implement the disciplinary decision and notify the non-disciplinary action to the Party organization, the violating Party member and relevant organizations and individuals.
The Central Inspection Commission completes the file for review, disciplinary action and hands it over to the Party Central Office for archiving according to regulations.
The Party Central Committee, the Politburo, and the Secretariat assigned the Central Inspection Commission to monitor, urge, inspect, and supervise relevant Party organizations and Party members to comply with disciplinary decisions.
