According to Official Dispatch No. 33 signed by the Chairman of the Board of Directors of Nam Binh Wind Power Joint Stock Company, the Nam Binh 1 wind power plant with a capacity of 30 MW of Nam Binh Wind Power Joint Stock Company has been approved for investment by the Dak Nong Provincial People's Committee in Decision 1524 dated October 13, 2020. The plant has completed all construction investment, energized and conducted commercial operation acceptance (COD) tests before October 31, 2021. However, due to the short testing time and low wind speed, it has not been recognized by Vietnam Electricity (EVN) as COD under the FIT price mechanism.
Nam Binh 1 Wind Power is also the first transitional renewable energy project to propose temporary grid-connected power generation at 50% of the price bracket for onshore wind power plants from April 2023.
At the same time, the project has been inspected by the competent State agency for acceptance work and issued a document approving the acceptance results according to the content of Notice No. 75 dated October 29, 2021 of the Department of Electricity and Renewable Energy ( Ministry of Industry and Trade ).
Up to now, the Nam Binh 1 Wind Power Plant has been approved by the Ministry of Industry and Trade for temporary prices in Document 2973 dated May 18, 2023, and has signed a contract to amend and supplement the power purchase contract with EVN on May 18, 2023. "The project has completed the tests to serve the recognition of commercial operation date (COD) in accordance with regulations. During the testing period, the plant has generated more than 2 million kWh to the grid. The plant is completely ready for commercial power generation," said the official dispatch of Nam Binh Wind Power Joint Stock Company.
However, according to this enterprise, the dossier to be recognized for the commercial operation date and the effective amendment and supplement to the power purchase contract of Nam Binh 1 Wind Power Plant must include the Decision to adjust the Decision approving the investment policy on adjusting the implementation progress of the Nam Binh 1 Wind Power Plant project.
However, Nam Binh 1 wind power plant has been operating for the first time since October 2021. Although it has not generated any revenue from selling electricity, the plant is still being operated, maintained, and in compliance with regulations on the operation of a power plant. "Therefore, the requirement to have a decision to adjust the investment policy on the project implementation progress seems to be imposing and misunderstanding, leading to difficulties for investors in getting the project's commercial operation date recognized," the investor emphasized.
The investor said that he still submitted the documents to the locality to complete the procedures for adjusting the investment policy, the Department of Planning and Investment of Dak Nong province sought opinions from all parties. Up to now, the People's Committee of Dak Nong province has not yet issued a decision to adjust the investment policy for the project. Therefore, the project still has no specific plan or solution for the investor to complete the legal procedures for generating electricity soon.
Because of not operating commercially, investors continue to lose capital, disrupt business plans, exceed the ability to continue operating, and move towards bankruptcy.
Based on the above reality, Nam Binh Electricity Joint Stock Company recommends that the Prime Minister and Deputy Prime Minister consider the urgent situation of the enterprise, allowing Nam Binh 1 wind power plant to generate electricity to the grid and pay for the generated electricity output according to the temporary unit price approved by the Ministry of Industry and Trade and the amended and supplemented contract signed with EVN, avoiding waste of clean electricity resources, minimizing power shortages during the hot season...
Nam Binh's appeal to the Prime Minister also cited Notice 182 dated May 17, 2023 of the Government Office announcing the conclusion of Deputy Prime Minister Tran Hong Ha, stating: "For projects that are not yet qualified for implementation and still have problems with legal procedures, the Ministry of Industry and Trade and localities where there are transitional power projects must urgently guide businesses to complete the procedures and documents according to regulations."
