The Ministry of Home Affairs proposed to readjust the leadership position allowance coefficient for cadres, civil servants, public employees and armed forces from January 1, 2026, to ensure compliance with the new organizational model.

The draft decree was developed by the Ministry of Home Affairs to perfect the leadership position allowance regime in the context of strong changes in the organizational system in the spirit of arrangement, streamlining and implementation of the 2-level local government model.

The amendment is within the framework of the Politburo 's direction, especially according to Regulation 368-QD/TW and Conclusion 206-KL/TW on adjusting the allowance regime from 2026.

Major adjustments to position allowances of Departments under the Ministry

An important content of the draft is to reclassify the Departments under the Ministry into two groups: Type 1 Departments and Type 2 Departments. For Type 2 Departments, the position allowance coefficient remains the same as the current regulations in Decree 204. As for Type 1 Departments, the coefficient is raised, 0.10 higher than the equivalent position of Type 2 Departments.

Accordingly, the new allowance coefficient for Type 1 Departments includes: Department Director 1.10, Deputy Department Director 0.90, Department Head or Branch Director 0.70, Deputy Department Head 0.50. Positions in the branch are supplemented with an allowance of 0.30 for the head level and 0.20 for the deputy head level.

The draft also abolishes all leadership allowances of General Departments and Departments under the General Department because the General Department model ceases operation from March 1. The coefficients of these organizations will be applied according to the allowance framework of Departments under the Ministry.

Building allowances for commune-level leadership positions according to a 2-level model

From July 1, local governments will operate under a two-tier model. According to the analysis of the Ministry of Home Affairs, the functions, tasks and powers of the commune level after the reorganization are no longer similar to the previous district level, so it is necessary to adjust the allowances to avoid the understanding that "the commune level is a miniature district level".

The draft design has two allowance levels depending on the locality: one level applies to communes, wards, and special zones in Hanoi and Ho Chi Minh City; the other level applies to other localities.

Specifically, the chairperson of the People's Committee at the commune level enjoys a coefficient of 0.70 in Hanoi and Ho Chi Minh City, and 0.60 in other provinces; the vice chairperson is 0.60 and 0.50 respectively. The head of a department under the People's Committee of the commune has an allowance coefficient of 0.35 in the two large cities and 0.25 in the remaining localities. The deputy head of a specialized department under the People's Committee of the commune has a coefficient of 0.20 in the two large cities and 0.15 in the remaining localities.

At the same time, the old regulations on allowances for the chairman and vice chairman of the People's Committee at the commune level in Decree 33/2023 are abolished to synchronize with the new system.

Amendment of leadership position allowances in the inspection system

According to the 2025 Law on Inspection, the inspection organization structure is redesigned, leading to the requirement to adjust allowances accordingly. The draft removes the regulations on position allowances for Department Inspectors and District Inspectors; only keeping two groups: Ministry Inspectors and Inspectors under Departments of the Ministry.

The allowance for the Chief Inspector of the Ministry remains at a coefficient of 1.00; for the Deputy Chief Inspector at 0.80. For inspectors under the Department, the allowance level is determined equivalent to the Head or Deputy Head of the Department under the Department.

Provisions for transition and retention of allowances

To avoid policy disruption during the organizational model transition period, the draft clearly states the principles of allowance retention and retroactive payment:

Commune-level leaders who have not received allowances or are receiving lower levels during the period from July 1, 2025 to December 31, 2025 will receive back pay according to the new coefficient and pay back social insurance. Department leaders under the Ministry during the period from March 1 to before the decision to classify the Department will temporarily apply the allowance of the Department type 2 and will receive back pay for the difference.

Cases that are enjoying higher position allowances due to organizational restructuring will continue to be reserved until the end of the term according to previous regulations.

According to the draft, the amended decree will take effect from January 1, 2026, and at the same time abolish many regulations on position allowances that are no longer suitable in the context of ending the General Department model and switching to a two-level local government.

The draft emphasizes that adjusting leadership position allowances is a necessary step to ensure consistency with the Party's policies, in line with the new organizational model, and at the same time contributing to improving the effectiveness of state management and the quality of service to the people.
