Continuing the program of the 10th Session, on the morning of October 31, the National Assembly listened to the Presentation and Verification Report on the draft Law on High Technology (amended), the draft Law on Digital Transformation, and the draft Law on amending and supplementing a number of articles of the Law on Technology Transfer.
Clarify more about guaranteed resources and coordination mechanisms
According to the High Technology Law Project Report presented by Minister of Science and Technology Nguyen Manh Hung, the draft Law consists of 6 chapters and 27 articles, a reduction of 8 articles and changes in structure and form compared to the current High Technology Law.
The draft Law is designed according to the principles of simplifying administrative procedures, strengthening post-auditing, and comprehensive digital transformation in high-tech management and operations. Changing management thinking towards effective management, not process management. Attracting non-state budget investment sources for high technology by encouraging enterprises to invest and sponsor research and development of high technology, strategic technology, high-tech products, and strategic technology products. Maximizing the inheritance of the contents of the 2008 Law on High Technology, which has been effectively implemented in recent times.

The report on the review of the draft Law on High Technology (amended) presented by Chairman of the Committee on Science, Technology and Environment Nguyen Thanh Hai stated that the Committee basically agreed with the necessity of promulgating the draft Law following a shortened order and procedure.
Regarding specific contents on the State's policy on high-tech and strategic technology development (Article 4), the Committee believes that the draft Law has stipulated many preferential, supportive, attractive and encouraging policies for investment, production and business activities in the high-tech sector.

However, it is necessary to clarify more about the guaranteed resources as well as the coordination mechanism between agencies in implementation; it is necessary to stipulate that incentives in high-tech production activities should only be applied during the time when enterprises meet the prescribed criteria. For high-tech projects in ethnic minority, border, and island areas, etc., it is necessary to study and supplement policies on corporate income tax exemption and reduction, support for 0% interest loans for investment in digital infrastructure development, and prioritize land allocation for high-tech zones.

Incentives and support for small and medium enterprises
Presenting the Draft Law on amending and supplementing a number of articles of the Law on Technology Transfer, Minister of Science and Technology Nguyen Manh Hung stated that the amended and supplemented contents focus on 6 policy groups. Accordingly, the scope of high technology is supplemented according to world trends and practical requirements; strategic technology and priority technology transfer objects are supplemented; technology appraisal regulations are regulated not only in investment projects but also at the request of organizations and individuals to suit practical requirements.

The law supports the promotion of endogenous technology transfer and commercialization of research results. Regulations on the form of expressing ownership and right to use technology, and capital contribution in the form of technology. The State automatically transfers the right to self-determination of technology ownership and self-negotiation of value to organizations that create technology using the State budget. The State purchases and disseminates technology for the purpose of applied research to serve the public interest. Regulations on compulsory technology transfer cases in accordance with the law and international requirements.
Along with that, developing the science and technology market, amending and supplementing regulations on the state budget allocation to develop a network of intermediary organizations in the science and technology market to support technology transfer activities, strengthening public-private cooperation to attract social resources to develop intermediary organizations...

According to the Report on the review of the Law project presented by Chairman of the Committee on Science, Technology and Environment Nguyen Thanh Hai, the Committee on Science, Technology and Environment basically agrees with the expansion of a number of subjects of technology transfer in line with the world trend (such as green technology, clean technology). However, the expansion of the scope for "technology appraisal" in general without limiting technology appraisal to investment projects as stipulated in the current Law on Technology Transfer needs to be further reviewed to ensure feasibility in implementation and synchronization with relevant laws.
Regarding the State's policy on technology transfer activities, it is recommended that the drafting agency conduct research, closely follow the orientation and requirements of Resolution No. 57-NQ/TW dated December 22, 2024 of the Politburo, and add to the draft Law preferential and support policies for small and medium-sized enterprises in research, reception, innovation, mastery and application of technology. In addition, it is recommended to review and research additional incentive mechanisms to effectively implement the policy of "diffusion of technology... from foreign-invested enterprises (FDI) to domestic enterprises".
Adding emerging high-tech crimes
The draft Law on Digital Transformation was presented by Minister of Science and Technology Nguyen Manh Hung. Accordingly, the draft Law regulates digital transformation, including infrastructure for digital transformation, digital government, digital transformation of activities of agencies in the political system, digital economy, digital society and measures to ensure digital transformation.
Regarding the subjects of application, the Law applies to Vietnamese agencies, organizations and individuals, foreign organizations and individuals directly participating in or having activities related to digital transformation in Vietnam.

The review report of the Digital Transformation Law project presented by Chairman of the Committee for Science, Technology and Environment Nguyen Thanh Hai stated that the drafting agency has designed many outstanding policies to promote digital transformation. However, for digital transformation projects and tasks using the state budget, it is recommended to consider adding a group of preferential policies and special support on investment, procurement and financial management to ensure flexibility and efficiency.
The Committee on Science, Technology and Environment also basically agreed with the provisions on prohibited acts in the draft law. However, to cover and be consistent with the current situation, it proposed to add provisions on emerging high-tech crimes such as using artificial intelligence (AI) or other digital technologies to create fake content or cause division and discrimination in cyberspace.
