Therefore, the Department proposed that the City request the Prime Minister to consider and approve allowing the Hanoi People's Committee to issue a decision to reclaim land (without compensation for property damage or investment costs in the land; without providing support when the state reclaims the land), change the land use purpose, allocate land, and lease land without auctioning the land use rights or bidding to select investors to implement the project using the land for the Joint Venture of Investors to continue implementing the project according to the plan.

Regarding the land plot at 94 Lo Duc Street (Hai Ba Trung District), it is a corner plot with four street frontages, situated between Nguyen Cong Tru, Thi Sach, Hoa Ma, and Lo Duc streets. This location was formerly the Hanoi Distillery, managed by the Alcohol and Spirits Joint Stock Company.
Following the policy of relocating factories out of the inner city, since 2013, the Hanoi People's Committee has cleared the land and planned to build a school on this plot. After the land was reclaimed, it was assigned to Thien Binh Urban Investment and Development Company Limited for research and project development.
Thien Binh Urban Investment and Development Company Limited, headquartered at 94 Lo Duc Street, has Mr. Do Anh Dung as its legal representative (contributing 99% of the capital). At that time, Mr. Do Anh Dung was also the Chairman of Tan Hoang Minh Group Joint Stock Company.
Currently, part of the land has been used to build a school and a flower garden. The project area remains abandoned, overgrown with weeds taller than a person's head. According to the Chairman of the Hanoi People's Committee, the project for a complex of offices, hotels, shopping centers, and apartments for sale at 94 Lo Duc Street has dragged on for many years. At this point, the city needs to focus on resolving the issue to prevent waste and avoid losses to the State. Chairman Tran Sy Thanh of the Hanoi People's Committee requested that this project be definitively resolved by January 2025.
Another project that the Chairman of the Hanoi People's Committee, Tran Sy Thanh, has directed to be resolved is the land plot at 31-33-35 Ly Thuong Kiet Street, with an area of 2,245 square meters. This is a very special location because it has three street frontages on Ly Thuong Kiet, Hang Bai, and Vong Duc streets, and is currently under the ownership of Saigon - Hanoi Commercial Joint Stock Bank (SHB).
According to our findings, the investor of this project proposed building the bank's headquarters with a scale of approximately 45 meters, equivalent to more than 13 floors. However, the basic planning regulations for the area stipulate that buildings should not exceed 8 floors.
To resolve the issue, Chairman of the Hanoi People's Committee Tran Sy Thanh assigned the Department of Planning and Architecture to take the lead in coordinating with the Hoan Kiem District People's Committee to prepare urban design plans for the streets in December 2024, and submit them for appraisal and approval in accordance with current laws. After the plan is approved, SHB Bank will finalize the investment proposal for the project and submit it to the competent authority for approval.
