This Resolution regulates the establishment, adjustment and approval of zoning plans when implementing the arrangement of administrative units at all levels and the organization of 2-level local governments; applicable to urban areas that play a role in promoting local socio -economic development, with a forecast population size over a 10-year period of 45,000 people or more for centrally-run cities; 15,000 people or more for provinces formed after the arrangement in mountainous, highland and border areas; 21,000 people or more for the remaining provinces formed after the arrangement.
Principles and requirements for establishing new, adjusting and approving zoning plans
The Resolution clearly states: Zoning plans for urban areas can be newly established or adjusted at the same time as the process of establishing or adjusting provincial planning or general urban planning and approved before the approval of provincial planning or general urban planning. After approval, zoning plans are updated and integrated into provincial planning or general urban planning to ensure consistency and synchronization.
The content of zoning planning for the area expected to form an urban area shall comply with the provisions of the law on urban and rural planning and ensure the following requirements: Boundaries and area scale for zoning planning shall be specified in the decision approving the planning task based on review and determination of the nature, function, role in promoting socio-economic development and the ability to connect technical infrastructure and social infrastructure of the area expected to be planned; comply with the norms and standards on urban and rural planning and relevant legal provisions.
Authority, order and procedures for establishing new, adjusting and approving zoning plans
The Resolution clearly states that the Provincial People's Committee assigns tasks to affiliated agencies and units to establish planning tasks and zoning plans.
The specialized agency for urban and rural planning at the provincial level organizes the appraisal of planning tasks and zoning plans.
The People's Committee at the provincial level considers and approves planning tasks and zoning plans based on appraisal reports and documents submitted by specialized agencies on urban and rural planning at the provincial level.
The People's Committee at the provincial level shall report to the People's Council at the same level for decision before approval in case the zoning plan for the urban area changes beyond the provincial land use norms according to the land law.
The People's Committee at the provincial level shall report to the People's Council at the same level for decision before organizing new establishment or adjustment in case the forecast population size is lower than the level specified in Article 1 of this Resolution.
The order and procedures for collecting opinions, appraising and approving planning tasks and zoning plans in Clauses 1, 2 and 3 of this Article shall comply with the provisions of law on urban and rural planning.
This Resolution takes effect from the date of issuance (July 18, 2025) to February 28, 2027.
In case laws, resolutions of the National Assembly , ordinances, resolutions of the National Assembly Standing Committee are amended, supplemented or newly issued and come into effect after the date of this Resolution's adoption and before March 1, 2027, the corresponding provisions issued in this Resolution shall cease to be effective.
During the effective period of the provisions of this Resolution, if the provisions on authority, responsibility for state management, order and procedures in this Resolution are different from relevant legal documents, the provisions of this Resolution shall apply.
