Government: Do not require people to present documents integrated on VNeID

(Dan Tri) - The Government's new regulation clearly states that "people must not be required to submit or present documents that have been integrated on VNeID when the person requesting authentication has presented corresponding information from VNeID".

The Government has just issued Decree 280 amending and supplementing a number of articles of Decree No. 23 on issuing copies from original books, certifying copies from originals, certifying signatures and certifying contracts and transactions.

The new Decree of the Government amends in the direction of expanding the subjects of certification.

Specifically, the person performing the certification is the chairman of the People's Committee of the commune, ward, or special zone; the person authorized or assigned to perform the certification task according to regulations; the notary of the Notary Office, Notary Office (notary practice organization); the diplomatic officer, consular officer of the diplomatic representative agency, consular representative agency, and other agencies authorized to perform consular functions of Vietnam abroad.

The Government stipulates that people cannot be required to present documents integrated on VNeID (Illustration: Cong Binh).

Compared with the old regulations, Decree No. 280 expands the subjects of certification to include authorized or assigned persons to perform certification tasks according to regulations.

The Decree also supplements regulations on the obligations and rights of the person performing the certification.

In Decree 280, the Government clearly states that “the person performing the authentication does not require the certifier to submit or present the original or a copy of the papers and documents that have been integrated on VNeID”.

In case the person requesting certification requests and the person performing certification can exploit information and documents from the National Population Database or other databases as prescribed by law, the person performing certification is responsible for exploiting information and documents from these databases, and does not require the person requesting certification to present the original, a copy from the original book or a certified copy of the exploited information and documents.

The responsibilities of People's Committees at all levels in State management of authentication are also amended to meet the requirements when operating the organization and operation of the 2-level local government model.

The Decree recently issued by the Government also amends and supplements regulations on the authority and responsibility of certification in the direction of clearly defining the responsibilities of each subject performing certification.

In which, the Chairman of the People's Committee at the commune level has the authority and responsibility to:

- Certify copies from originals of documents and papers issued or certified by competent agencies and organizations of Vietnam; competent agencies and organizations of foreign countries; competent agencies and organizations of Vietnam in association with competent agencies and organizations of foreign countries.

- Authentication of signatures in documents and papers.

- Certify the translator's signature in documents and papers from foreign languages ​​to Vietnamese, and from Vietnamese to foreign languages.

- Certification of transactions related to movable property.

- Certify transactions related to land user rights according to the provisions of land law.

- Certification of housing transactions according to the provisions of the law on housing.

- Probate.

- Certification of documents refusing to receive inheritance.

- Certify documents dividing inheritance assets specified in points d, dd and e above.

Certification does not depend on the place of residence of the person requesting certification in the following cases: Certification of copies from originals, certification of signatures; Certification of transactions related to movable assets; Certification of wills, certification of documents refusing to receive inheritance; Certification of authorization documents related to the exercise of rights of land and housing users...

The certification of transactions related to land use rights is carried out at the People's Committee of the commune where the land is located, the certification of housing transactions is carried out at the People's Committee of the commune where the house is located.
