The public disclosure of responsibility for inheriting the obligation to enforce administrative judgments in Khanh Hoa province regarding judgments and decisions of the court in administrative cases that have become effective but have not yet been enforced or are currently being enforced, is carried out according to the guidance of the Ministry of Justice and the proposal submitted by the Provincial Department of Justice.
According to the announcement by the Chairman of the People's Committee of Khanh Hoa province, the public disclosure of the obligation to inherit and enforce 34 administrative judgments and 1 court decision regarding an administrative case that must be enforced is "aimed at enhancing the responsibility of heads of state administrative agencies in complying with administrative procedural law and enforcing administrative judgments."
At the same time, it is to "ensure openness and transparency in accordance with the law; create favorable conditions for organizations and individuals who are the parties to the enforcement of judgments and related agencies and organizations to proactively grasp information and exercise their rights and obligations as the judgment debtors as prescribed."
The current obligations of each agency and unit in Khanh Hoa province regarding the 35 administrative judgments and court decisions to inherit and enforce the aforementioned administrative judgments and decisions are to be publicly disclosed by posting them on the Khanh Hoa provincial electronic information portal, the provincial website, and by publicly displaying them at the headquarters of the agencies and units responsible for inheriting and enforcing these administrative judgments after organizational restructuring.
The Chairman of the People's Committee of Khanh Hoa province requested that the heads of departments, agencies, and branches, the chairmen of the People's Committees of communes, wards, special zones, and other agencies and units identified as entities responsible for inheriting the obligation to enforce administrative judgments publicly and seriously implement the administrative judgment enforcement obligations under their responsibility; ensuring transparency of relevant information, creating favorable conditions for organizations and individuals to exercise their rights and obligations according to the law.
The Department of Justice of Khanh Hoa province is tasked with monitoring and urging agencies, units, and localities to implement the directive on the obligation to inherit and enforce administrative judgments in Khanh Hoa province as mentioned above.
The responsibility for inheriting and enforcing administrative judgments rests with the Chairman of the People's Committee of Khanh Hoa province and relevant departments and agencies.
Of the 34 administrative judgments and 1 court decision that have come into effect in Khanh Hoa province and have just been publicly announced, there are 21 first-instance administrative judgments issued by the People's Courts of the former Khanh Hoa and Ninh Thuan provinces and the current People's Court of Khanh Hoa province (from March 2022 to June 2025).
The remaining 13 administrative appeals were all heard and decided by the two High People's Courts in Da Nang and Ho Chi Minh City.
Among them, the administrative appeal judgment has been in effect for the longest time, more than 3 and a half years to date (issued by the High People's Court in Da Nang on March 11, 2022).
The aforementioned administrative appeal judgment was previously the responsibility of the Khanh Hoa Provincial Department of Natural Resources and Environment to enforce, and now the Khanh Hoa Provincial Department of Agriculture and Environment must inherit that enforcement obligation.
The Department of Agriculture and Environment of Khanh Hoa province currently has the responsibility to inherit and enforce two first-instance and appellate judgments in the administrative case in Van Ninh district (formerly Khanh Hoa province).
The current Chairman of the People's Committee of Khanh Hoa province is obligated to inherit and enforce four administrative judgments at the first instance and appellate levels, in two administrative cases in the former Khanh Hoa province and the former Ninh Thuan province, which were the responsibility of the chairmen of the People's Committees of the two former provinces.
The People's Committee of Khanh Hoa province and the Provincial Tax Department of Khanh Hoa are currently obligated to inherit and implement the administrative case decision issued by the Khanh Hoa Provincial People's Court in June 2025. The Head of the Khanh Hoa Provincial Tax Department is also obligated to inherit and implement a previous first-instance administrative judgment in Ninh Thuan province.
For all administrative judgments at the first instance and appellate levels that have become enforceable, which were previously the responsibility and obligation of the People's Committees and Chairmen of the People's Committees of Nha Trang City, Phan Rang - Thap Cham City and the relevant districts of the former Khanh Hoa and Ninh Thuan provinces, the People's Committees and Chairmen of the People's Committees of the newly relevant communes and wards are now responsible for receiving and inheriting the obligation to enforce those administrative judgments.
