Proposal to exempt "overtime pay" and "night shift pay" from taxes.

On the afternoon of November 5th, continuing the program of the tenth session, National Assembly deputies discussed in groups the draft Law on Tax Administration (amended); the draft Law on Personal Income Tax (amended); and the draft Law on Practicing Thrift and Combating Waste (amended).

"For sustainable savings practices to be effective, they must be linked to benefits."

According to the draft Law on Practicing Thrift and Combating Waste (amended), Representative Truong Xuan Cu (Hanoi Delegation) argued that one of the shortcomings of the current Law is its narrow scope, mainly focusing on the State sector. Meanwhile, the practice of thrift needs to be expanded to the entire society, from state agencies, businesses, political and social organizations to individual citizens.

Analyzing the practical situation, delegate Truong Xuan Cu argued that the mechanisms for monitoring, inspecting, and handling violations in the field of saving and combating waste are not effective. Many of the National Assembly 's oversight activities are very thorough, but the implementation after the conclusions is still not strong or substantive. Therefore, the delegate proposed adding specific regulations and increasing sanctions for heads of departments when waste occurs, while also establishing a mechanism for appropriately rewarding units and individuals who perform well.

Meanwhile, delegate Le Quan (Hanoi delegation) argued that there should be a mechanism for rewarding and providing material incentives to collectives and individuals who effectively practice thrift and combat waste. The delegate emphasized that practicing thrift is not just about limiting spending, but about using resources effectively and bringing concrete benefits to organizations and individuals.

According to the delegates, current laws focus primarily on inspection, auditing, and disciplinary action, while lacking mechanisms for rewarding and encouraging collectives and individuals with initiatives to save resources and use them efficiently. Therefore, regulations on reward systems, increased income, or material incentives should be added for initiatives and solutions that effectively save budget and combat waste.

"For austerity practices to be sustainable, they must be linked to benefits. Similar to the previous 'contract farming' model, without concrete benefits, it's difficult to inspire initiative in each individual," Representative Le Quan analyzed.

Representative Le Quan also argued that the public sector is where the reward mechanism should be strongly applied, as it has much potential for saving resources, especially in asset management, human resource utilization, and organizational restructuring.

Help taxpayers feel "proud to contribute to the budget."

During the discussion on the draft Law on Personal Income Tax (amended), delegate Le Nhat Thanh (Hanoi delegation) suggested researching and adding provisions to exempt "overtime pay" and "night shift pay" from tax, as these are incomes that serve to motivate employees.

According to the delegates, taxing these amounts would reduce the incentive offered by policies such as bonuses for exceeding labor productivity targets, while also disadvantaging workers, especially those working night shifts, overtime, and unskilled labor. Furthermore, regarding taxable income from inheritance and gifts, the criteria for determining unregistered assets need to be clarified to ensure transparency and prevent arbitrary application.

Regarding the same issue, delegate Le Quan suggested that personal income tax should be designed to ensure fairness and create incentives for work and contribution, making taxpayers feel "proud to contribute to the budget." The delegate argued that the current personal allowance is only temporarily acceptable, and lacks a flexible adjustment mechanism based on the base salary or minimum wage.

Representative Le Quan proposed adding a regulation authorizing the Government to adjust the personal allowance deduction to reflect changes in income, prices, and people's living standards. At the same time, the drafting agency needs to clarify the regulations on income tax exemption for cases of transferring or gifting real estate within family relationships (spouses, grandparents - adopted grandchildren, siblings, etc.), avoiding differing interpretations that could cause practical problems.

In particular, overtime and night shift income within the low-income bracket should be exempt from tax, helping workers reduce the burden of tax declaration and encouraging them to improve their living standards.

Discussing this issue, delegate Hoang Van Cuong (Hanoi delegation) argued that tax policies need to be adjusted more flexibly to ensure they are consistent with fluctuations in income and prices, and fair to different groups of taxpayers. According to the delegate, amending the Personal Income Tax Law is necessary because, in recent times, factors such as prices, income, and spending by the people have fluctuated significantly.

Delegates agreed with the provision that the Government should decide the amount of personal allowance based on price and income fluctuations, instead of a rigid regulation in the Law. However, it is necessary to clarify the adjustment principle, including: The allowance must be consistent with the highest level of price or income fluctuations, so that people are not taxed on the portion of income that should be used for essential expenses.

Regarding the progressive tax system, delegates argued that reducing the number of tax brackets from seven to five, as proposed in the draft, is unreasonable. They also suggested maintaining the seven tax brackets, each separated by 5%, arguing that this approach "is more equitable and does not stifle the motivation of workers to strive for gradually increasing incomes."

Regarding the gold tax policy, delegate Hoang Van Cuong argued that while the 0.1% tax on gold transactions is not high, it needs careful consideration because gold is a legitimate asset for people to store. When the gold market fluctuates sharply, the influx of money into speculation can increase domestic prices, creating a disparity with world prices, affecting exchange rates and production and export activities.

Therefore, the delegates proposed that the government be allowed to apply a temporary gold tax in cases of unusual market fluctuations, in order to stabilize the market, rather than as a permanent policy.
