Proposal to draw 'lessons' from major 'rescue flight' cases, AIC

On the morning of September 13, continuing its 26th session, the Standing Committee of the National Assembly gave its opinion on the Government's report on anti-corruption work in 2023 (reporting period from October 1, 2022 to July 31, 2023).

54 people were penalized for making false asset declarations.

In its report to the National Assembly, the Government stated that there have been positive changes in the openness, transparency, and accountability of agencies and units in their organization and operation.

According to the report, in the past 10 months, there have been 23 cases of individuals returning gifts to their units, totaling 93 million VND. Of these, the State Bank of Vietnam accounted for 19 people, Ho Chi Minh City had 1 person, and Da Nang had 3 people.

Regarding the control of assets and income of officials and those in positions of power, the Government stated that from February 8, 2022, to April 30, 2023, more than 13,000 people had their assets and income verified. Of these, 54 were disciplined for dishonesty in declaring their assets and income and explaining the source of their increased assets. These individuals were disciplined in various ways, such as removal from the list of candidates, warnings, and dismissal from their positions.

Overall, the Government emphasized that it had resolutely clarified and assigned political responsibility to the heads of departments for violations and shortcomings in their assigned areas of management and responsibility, thereby encouraging officials to voluntarily acknowledge their mistakes and responsibilities and resign.

In addition, inspection, supervision, auditing, investigation, prosecution, and adjudication have been strengthened, detecting and severely punishing many violations; proactively detecting, initiating, investigating, and prosecuting particularly serious cases in highly specialized fields with closed-loop, organized operations (healthcare, education, diplomacy, corporate bonds, vehicle inspection, smuggling, etc.).

In particular, according to the Government, a highlight of this work is the investigation, prosecution, and trial in absentia of fugitives; paving the way for the handling of many fugitives in other cases; and serving as a basis for the extradition of criminals who have been convicted by the court.

"This also serves as a wake-up call, a deterrent, and a basis for research, the issuance of precedents, and their consistent application nationwide," the report stated.

Nevertheless, the government acknowledges that corruption remains complex, unpredictable, increasingly sophisticated, and involves many organized cases with vested interests; corrupt assets are of high value and have foreign elements...

The practice of appointing and assigning family members to positions still persists.

Reviewing the government's report, the Deputy Chairman of the National Assembly's Judicial Committee stated that the committee highly appreciates the results in this work, such as the strengthened control over the assets and income of officials and those in positions of power, and the timely detection and strict handling of cases of dishonest asset and income declarations, including those involving high-ranking local leaders and managers.

For example, the report of the Judicial Committee mentions cases such as the Secretary of the Ben Tre Provincial Party Committee Le Duc Tho, the Director of the Department of Industry and Trade of Ca Mau province... who were considered for disciplinary action for dishonest declaration of assets and income...

However, Mr. Cuong also pointed out many limitations that are not new and have persisted for many years, but the Government has yet to find effective solutions to overcome them.

Typically, there is still a situation where family members and relatives are appointed to leadership and management positions within the same agency, organization, or unit in violation of regulations.

Mr. Cuong reiterated that in its annual reports on anti-corruption work, the Judicial Committee has repeatedly requested the Government to direct the rectification of the opaque and irregular placement and appointment of officials; however, this situation still persists.

Furthermore, the auditing agency noted that internal self-inspection and detection of corruption have not improved. Very few cases of corruption have been discovered through self-inspection.

In its overall assessment, the Judicial Committee acknowledges that corruption and negative practices in some areas remain serious and complex; collusion, connivance, and complicity by state officials with businesses to engage in corruption, profiteering, and misappropriation of state assets are still prevalent in some sectors.

Furthermore, corruption continues to occur within law enforcement agencies, the very agencies tasked with combating corruption. Statistics show that the investigative agency of the Supreme People's Procuratorate has initiated legal proceedings in 45 cases, involving 82 defendants, for corruption offenses occurring within the judicial system.

Therefore, the Judicial Committee recommended that the Government strengthen inspection, examination, and auditing work, focusing on areas such as public asset management, bidding, auctions, finance, banking, securities, and bonds... Effectively prevent harassment, negative practices, and petty corruption that cause inconvenience to citizens and businesses.

Notably, based on the results of investigations and handling of serious and complex corruption and malpractice cases (such as the "rescue flight" case, cases related to vehicle inspection, AIC, etc.), the National Assembly's Judicial Committee proposed a clearer assessment of the causes and conditions giving rise to these crimes, drawing lessons learned, and thereby rectifying and strengthening state management and socio-economic management to prevent and deter similar incidents.
