
The A3 Residential Area Technical Infrastructure Project has a total land area of 151,546m2, with a total investment of 46 billion VND. The project's objective is to build a new residential area to resettle households living in areas eroded by sea encroachment in Phan Ri Cua commune and neighboring areas; reserve a part of the land for auction to create a source of investment for infrastructure for the project; improve the environment, and contribute to urban beautification. The investor is the Management Board of Investment Projects for Construction of Agricultural Works and Rural Development in Binh Thuan (now the Management Board of Agricultural Projects of Lam Dong province). The project has been implemented since 2009.
The inspection conclusion clearly stated the shortcomings and limitations of the project: The investor accepted the volume of some construction items higher than the actual construction with a value of more than 1.1 billion VND, violating the provisions of Article 29 of Decree No. 12/2009/ND-CP dated February 12, 2009 of the Government regulating the management of construction investment projects. At the time of the inspection, the People's Committee of Chi Cong commune (now Phan Ri Cua commune) had not yet handed over an area of 8,524 m2 to the investor to implement the construction of the main items of the project. Some households had arbitrarily encroached on the area, built temporary structures on some areas of the project. In particular, the project was 12 years behind schedule since January 5, 2009 according to Decision No. 23/QD-UBND of the People's Committee of Binh Thuan province, the investor had not yet completed the procedures to extend the investment schedule.
The Provincial Inspectorate determined that the responsibility for the limitations and violations belonged to the Chairman of Tuy Phong District People's Committee (before the reorganization) and the officers and civil servants assigned to directly advise during the periods from 2010 to 2025 due to not closely following, urging, and directing the compensation and site clearance work to implement the project. The Director and officers and civil servants of Lam Dong Provincial Land Fund Development Center - Branch 1 during the period from 2010 to 2025 were responsible for the delay in advising on the implementation of compensation and site clearance work to implement the project...
The Provincial Inspectorate recommends organizing a review and handling the responsibilities (if any) of officials and civil servants in the 2010-2025 period related to the above-mentioned shortcomings and limitations.
The Hong Chinh III Residential Area Technical Infrastructure Project, Hoa Thang Commune has a total investment of 43 billion VND, and an area of 80,500 m2. The project's objective is to build a new residential area with synchronous technical infrastructure to stabilize housing for households affected by natural disasters in the Hoa Thang coastal area and partially solve the housing needs of local people. The investor is the Binh Thuan Agricultural and Rural Development Construction Investment Project Management Board (now the Lam Dong Provincial Agricultural Project Management Board). The project has been implemented since 2014.
The inspection conclusion pointed out some limitations: The land acquisition and compensation work for the project lasted for 5 years (from 2017 to 2021). The work of measuring and counting to determine the names and permanent residence of people whose land was acquired was not strict, and it was necessary to issue decisions to amend and supplement the increase or decrease of the number of households during the process of counting households whose land was acquired. When the site was handed over for construction, the investor did not regularly coordinate with the People's Committee of Hoa Thang commune to resolve the land encroachment of households...
The inspection conclusion clearly stated that the investor is responsible for the existing problems and violations that occurred in the project. The People's Committee of Hoa Thang commune is primarily responsible for not completely resolving the issue of households encroaching on land outside the project boundary, and is jointly responsible for not coordinating to completely resolve the issue of 3 households encroaching on land in the project. The Director of the Bac Binh District Land Fund Development Center (now the Bac Binh Land Fund Development Board) is primarily responsible for the compensation and site clearance work that took place over a long period of time, and the measurement, counting, and identification of the names of the compensated people were not accurate, so they had to be changed and adjusted.
The Provincial Inspectorate proposed to review the Deputy Director of the Department of Construction for signing the report on the results of the appraisal of the adjustment and supplementation of the construction drawing design - estimate No. 429/SXD-QLXD&HTKT dated July 16, 2019; review the Director and Deputy Director of the Binh Thuan Agricultural and Rural Development Construction Investment Project Management Board (now the Lam Dong Provincial Agricultural Project Management Board) from the time of project implementation until the time of inspection; review the Chairman and Vice Chairman of the People's Committee of Hoa Thang commune for not coordinating in a timely manner to completely handle households encroaching on land in the project from October 2022 to August 29, 2025.
