Proposal to apply special mechanisms and policies for the Tan Phu - Bao Loc expressway.

The People's Committee of Lam Dong province has proposed applying special mechanisms and policies to the Tan Phu ( Dong Nai ) - Bao Loc (Lam Dong) expressway project.

The People's Committee of Lam Dong province has just submitted a report to summarize the implementation of Resolution No. 106/2023/QH15 of the National Assembly on piloting some specific policies on investment in road construction projects.

Notably, the Lam Dong Provincial People's Committee proposed applying special mechanisms and policies to the Tan Phu (Dong Nai) - Bao Loc (Lam Dong) expressway project.

Specifically, the Tan Phu (Dong Nai province) - Bao Loc (Lam Dong province) expressway project, implemented under the public-private partnership method, was added to the medium-term public investment plan using central government budget funds (domestic capital) for the period 2021-2025 by the Prime Minister in Decision No. 888/QD-TTg dated July 24, 2023, with a capital of 2,000 billion VND.

In accordance with Notice No. 144/TB-VPCP dated April 20, 2023, from the Government Office, the People's Committee of Lam Dong province is currently coordinating and agreeing with the People's Committee of Dong Nai province to report to the Prime Minister for approval of the adjustment of the allocation of central government budget funds already allocated to the Tan Phu - Bao Loc Expressway Project in Decision No. 888/QD-TTg dated July 24, 2023, with a capital of VND 2,000 billion. This allocation will be divided as follows: VND 420 billion to Dong Nai province and VND 1,580 billion to Lam Dong province for compensation, support, and resettlement in Dong Nai province, based on the compensation, support, and resettlement policy framework approved by the Prime Minister for the Tan Phu - Bao Loc Expressway Project.

However, Clause 9, Article 9 of the Budget Law stipulates that the budget of one locality may not be used to fund tasks of another locality.

Therefore, the Lam Dong Provincial People's Committee believes that if, during the implementation of compensation, support, and resettlement work in Dong Nai province, the amount exceeds the 420 billion VND allocated by the Central Government to Dong Nai province, Lam Dong will have to continue to balance and allocate local budget funds to Dong Nai province to complete the compensation, support, and resettlement work, which would be inconsistent with the above regulations.

Therefore, the Lam Dong Provincial People's Committee requested central ministries and agencies to study and propose the addition of a special policy mechanism allowing the Tan Phu - Bao Loc expressway project, implemented under the public-private partnership model, to apply a special mechanism using local budgets to support other localities in carrying out compensation, support, and resettlement work.
