According to the Ministry of Home Affairs, in recent times, the system of legal regulations on foreign workers working in Vietnam has been issued relatively fully and synchronously, contributing significantly to attracting foreign workers, especially human resources with high technical expertise and experience in management and operation, and investors to work in Vietnam, making up for the shortage of highly qualified workers in Vietnam.
However, in the context that Vietnam is attracting capable and financially capable investors, experts, and highly skilled workers to work in new industries and professions such as semiconductor industry, artificial intelligence, and digital transformation, it is necessary to have more flexible policies and reduce the time for granting work permits to meet the production and business needs of enterprises.
Therefore, the Ministry of Home Affairs has developed and completed the draft Decree regulating foreign workers working in Vietnam with many changes compared to Decree No. 152/2020/ND-CP and Decree No. 70/2023/ND-CP.
Notably, in the draft Decree, the Ministry of Home Affairs has amended the procedure for reporting and explaining the need to use foreign labor into the procedure for submitting application for a work permit. According to this plan, the time for granting a work permit is expected to be reduced from 36 days to 10 days, according to the schedule for submitting application for a work permit and reducing the administrative procedure of "Reporting and explaining the need, changing the need to use foreign labor" when the employer submits the application.
Along with that, to specify Resolution 57, the draft Decree amends the regulations on expert conditions in the direction of adding a number of cases where only university graduates are qualified to work in Vietnam in the fields of finance, science , technology, innovation, national digital transformation, fields that Vietnam prioritizes for development or according to cooperation agreements of the Vietnamese government without having to have experience in the above fields.
The Ministry of Home Affairs also added cases that are confirmed not to be subject to work permit issuance for experts in specific fields such as: Finance, science, technology, innovation, national digital transformation and priority development fields; lecturers... confirmed as experts by specialized ministries (Ministry of Science and Technology, Ministry of Education and Training ...).
In addition, the draft Decree adds a provision on "special cases decided by the Government upon the proposal of the Ministry of Home Affairs" to promptly consider and resolve the cases arising in the process of socio-economic development of the country.
According to the Ministry of Home Affairs, in reality, there are many cases of people working in new fields such as semiconductor industry, artificial intelligence, digital transformation or countries with friendly relations with Vietnam... who only have a university degree but no experience, so they are not qualified to work in Vietnam. Therefore, it is necessary to supplement the above cases to be qualified as experts working in Vietnam.
Electronic licensing
The draft also clearly shows the decentralization and delegation of authority in granting work permits to foreigners. Accordingly, in the case of foreign workers working in provinces and cities, administrative procedures will be carried out locally. In the case of foreign workers working for agencies, organizations, and enterprises established by the Government, the Prime Minister, ministries, ministerial-level agencies, and agencies under the Government, they can choose to submit applications for issuance, re-issuance, extension, and revocation of work permits and confirmation of not being eligible for work permits to the Ministry of Home Affairs or competent provincial agencies.
The draft also clearly states the orientation to promote the application of information technology in the management and issuance of foreign work permits. Accordingly, work permits for foreign workers working in Vietnam will be issued electronically and a unified database of foreign workers working in Vietnam will be built from the central to local levels, connecting with administrative databases on foreign citizens entering Vietnam.
In addition, the draft Decree stipulates the interconnection of issuing Criminal Records and work permits online to ensure convenience for agencies, organizations and enterprises when submitting applications.
Regarding health certificates, the draft amendments accept both certificates issued by foreign or Vietnamese medical facilities, as long as they are valid within 12 months from the time of application submission...
According to the Ministry of Home Affairs, by the end of 2024, there will be 161,992 foreign workers working in Vietnam. Of these, 12,797 are not required to have a work permit, while the remaining 149,195 are required to have a permit. Foreign workers come from about 110 countries, of which Chinese workers account for 30.9%, followed by South Korea at 18.3%, Taiwan (China) at 12.9% and Japan at 9.5%.
