Proposed Lunar New Year 2024 holiday schedule: 7 consecutive days, off from 29th or 30th of Lunar New Year

On September 22, 2023, the Department of Labor Safety ( Ministry of Labor, War Invalids and Social Affairs ) said that the agency had completed the draft plan for the 2024 Lunar New Year holiday and sought opinions from relevant ministries and branches before submitting it to the Prime Minister for decision.

Accordingly, the 2 options for the 2024 Lunar New Year holiday schedule proposed by the Ministry of Labor, War Invalids and Social Affairs both have the same number of days off: 07 days (including 5 days off according to the labor law, 2 days off in lieu of weekly days off).

Option 1 : Employees will have 7 days off, from Thursday, February 8, 2024 (December 29) to Wednesday, February 14, 2024 (the 5th day of Tet).

Option 2 : Employees will have 7 days off, from Friday, February 9, 2024 (December 30) to Thursday, February 15, 2024 (the 6th day of Tet).

In particular, because the 2024 Lunar New Year holiday coincides with a weekly day off, employees will be given 2 days off in compensation.

Of the above two options, the Ministry of Labor, War Invalids and Social Affairs proposes to choose option 1, because both options have the same number of days off, but option 1 ensures harmony of time off before and after Lunar New Year.

This proposed plan is aimed at civil servants, public employees, and workers in agencies and public service units.

For employees in private enterprises, it is encouraged to follow the leave plan of officials and civil servants.

Thus, enterprises can decide on their own Lunar New Year holiday schedule in 2024 based on the plan proposed by the Ministry of Labor, War Invalids and Social Affairs, but must notify employees at least 30 days in advance.

Number of Lunar New Year holidays according to labor law

Clause 1, Article 112 of the 2019 Labor Code stipulates the annual holidays for employees as follows:

Article 112. Holidays

1. Employees are entitled to take time off with full pay on the following holidays:

a) New Year's Day: 01 day (January 1st);

b) Lunar New Year: 05 days;

c) Victory Day: 01 day (April 30th);

d) International Labor Day: 01 day (May 1st);

d) National Day: 02 days (September 2 and 01 day before or after);

e) Hung King's Commemoration Day: 01 day (10th day of the 3rd lunar month).

Thus, workers get 5 consecutive days off for Lunar New Year.

Every year, based on actual conditions, the Prime Minister will decide specifically on the Lunar New Year holidays.

Compared to before, the Lunar New Year holiday is still 5 days but with the regulation of 1 day off before Tet and 4 days after Tet or 2 days before Tet and 3 days after Tet.
