According to Article 60 of the 2018 Road Traffic Law, people aged 16 and over are allowed to drive motorbikes with a cylinder capacity of less than 50cm³. Meanwhile, people aged 18 and over are allowed to drive two-wheeled motorbikes, three-wheeled motorbikes with a cylinder capacity of 50cm³ or more, trucks, passenger vehicles with less than 9 seats and similar types of motor vehicles.
The conditions for a driving license are based on the type, engine capacity, load capacity and use of the motor vehicle. Article 59 of the 2018 Road Traffic Law clearly stipulates that only two-wheeled motorbikes with a cylinder capacity of 50 cm3 or more need a driving license.
Regulations on age and health of drivers are stipulated in Article 60 of the 2018 Road Traffic Law.
According to Decree 100/2019/ND-CP, handing over a vehicle or allowing an unqualified person to drive a vehicle to participate in traffic will be subject to administrative penalties with different levels of fines, depending on the type of vehicle:
Motorcycles and mopeds: Individual violators will be fined from VND800,000 to VND2,000,000, while organizations can be fined from VND1,600,000 to VND4,000,000.
Cars and tractors: Individual violators will be fined from VND 4,000,000 to VND 6,000,000, while organizations can be fined from VND 8,000,000 to VND 12,000,000.
In case of handing over a vehicle to an unqualified driver causing a serious traffic accident, the person handing over the vehicle may be criminally prosecuted under Article 264 of the 2015 Penal Code (amended and supplemented in 2017).
Lightest penalty: Fine from 10,000,000 VND to 50,000,000 VND or non-custodial reform for up to 3 years if causing damage such as death, serious injury or major property damage.
Heavier penalty : Fine from 50,000,000 VND to 200,000,000 VND or imprisonment from 6 months to 3 years if causing more serious damage such as killing 2 or more people or causing greater property damage.
Maximum penalty: Imprisonment from 2 years to 7 years if the consequence is the death of 3 people or more or property damage of up to 1.5 billion VND.
In addition, the offender may also be subject to an additional fine of VND 10,000,000 to VND 30,000,000.
Handing over a vehicle to a minor is not only a violation of the law but also a lack of responsibility for traffic safety and the lives of others. Parents, guardians and vehicle owners need to understand the serious consequences of this, from administrative penalties to criminal prosecution if an accident occurs.
