Additional responsibility for consulting on urban planning
National Assembly Delegate Ta Dinh Thi (Hanoi Delegation) expressed his high agreement with the contents of the Economic Committee's inspection report, especially the content of promoting decentralization and delegation of power in the establishment, appraisal, approval, adjustment, and management of urban and rural planning to enhance the role, initiative, and responsibility of local authorities in accordance with their capacity and resources for implementation; associated with promoting the responsibility of control and supervision, ensuring unified leadership, direction, and management of the Central Government.
Also interested in the content of decentralization in planning appraisal and approval, National Assembly delegate Most Venerable Thich Bao Nghiem (Hanoi City Delegation) agreed to identify the agency for appraisal of tasks and planning at 3 levels: Ministry of Construction , provincial level, district level as stated in the draft Law in Article 35. However, the delegate said that it is necessary to clarify the concept of professional agencies at 3 levels, because professional agencies at the provincial level are different.
According to delegate Thich Bao Nghiem, the specialized agencies mentioned in the draft Law have the function of decentralized State management to carry out appraisal, determined according to the functions and tasks assigned when established, but when the locality has a number of specialized agencies all related to planning, it is very difficult to determine.
"The Draft Law should clearly state that the People's Committees at the provincial and district levels are responsible for decentralizing to specialized agencies with the function of carrying out the appraisal of tasks and planning according to the approval authority of the province and district," suggested delegate Thich Bao Nghiem.
Regarding the content of collecting opinions on urban and rural planning (section 6, chapter II), according to Venerable Thich Bao Nghiem, this is a requirement that needs attention. This is not only a content in the planning process but also a solution to solve the problems in planning and planning quality in the past.
The Draft Law has identified many specific contents on the responsibility for collecting opinions (Article 33) and the subjects, contents and forms of collecting opinions (Article 34), but there is still a lack of specific regulations on receiving and explaining contributed opinions. Therefore, the delegates proposed to add this content to the Draft Law.
Add regulations on inspection and supervision of planning work
Participating in the discussion, National Assembly delegate Ta Thi Yen (Dien Bien Province Delegation) agreed with the need to clearly define the urban and rural planning system in terms of planning types and levels; clarify the relationship with national, regional, provincial and specialized technical planning, ensuring consistency and synchronization in appropriate planning, consistent with the provisions of the 2017 Law on Planning.
Delegates believe that it is reasonable to allow the establishment of separate urban designs or architectural management regulations as a basis for management and development in urban areas that have developed stably, are oriented towards conservation, and have limited development.
Delegates suggested that the drafting agency study and add to the draft Law provisions on inspection and supervision of planning work; responsibilities and sanctions for agencies and organizations that do not implement or do not properly implement regulations on planning review and adjustment to help minimize the current situation of suspended planning.
Agreeing with the view that it is necessary to carefully and cautiously review to clarify the relationship between types of planning in the urban and rural planning system; regional planning with national planning... National Assembly delegate Nguyen Thi Yen (Ba Ria - Vung Tau Province Delegation) suggested that it is necessary to clearly define the position and role of types of planning, planning levels; ensure connectivity, coupling, avoid overlap, duplication, and conflicts in content between plans, causing waste of resources, difficulties in management, and creating barriers to socio-economic activities of people and businesses. In particular, it is necessary to clarify which content is in this law, which content is in the Law on Urban Development Management, and to review more clearly and specifically.
